Book excerpt: Après l’effondrement du système soviétique et l’alignement du nouveau droit russe sur les droits des pays de l’Europe continentale (le retour du nouveau droit russe dans la famille du droit continental), le maintien du régime d’accueil en Russie des jugements de droit privé prononcés par les tribunaux étrangers, fondé essentiellement sur l’existence du traité entre la Russie et l’Etat d’origine, a comme résultat l’isolement de l’ordre juridique national. Tandis que les nouvelles règles de la procédure et du droit international privé sont à jour du droit comparé, un petit défaut rédactionnel dans le texte de loi constitue un obstacle encore insurmontable à la réception des jugements étrangers. La doctrine et la jurisprudence cherchent des moyens de le contourner sans modifier les textes, en gardant néanmoins l’illusion que la réciprocité en la matière de la part de l’Etat étranger, qu’il s’agisse d’une réciprocité organisée par un traité ou d’une réciprocité de fait, est en soi suffisante pour subvenir à la mise à exécution des jugements étrangers. Le renoncement formel au principe de traité international (accompagnée de l’abandon de la conception publiciste de l’exequatur) semble être nécessaire, d’autant plus que les autres règles du droit russe, notamment celles relatives au contrôle de la compétence indirecte et de l’ordre public se révèlent être suffisamment élaborées et cohérentes pour assurer à l’ordre juridique national un degré de protection adéquat.

Organized by the REHSEIS group (Research on Epistemology and History of Exact Sciences and Scientific Institutions) of CNRS (National Center for Scientific Research), the colloquium was held from 3 to 6 April 1990 in the UNESCO building in Paris. This colloquium was an idea of Professor Roshdi Rashed who initiated this field of studies in France some years ago, and proposed "Sciences and Empires" as one of the main research programmes for the The project to organize such a colloquium was a bit REHSEIS group. of a gamble. Its subject, reflected in the title "Sciences and Empires", is not a currently-accepted sub-discipline of the history of science; rather, it refers to a set of questions which found autonomy only recently. The terminology was strongly debated by the participants and, as is frequently suggested in this book, awaits fuller clarification.
