Regulations are of critical importance in shaping the welfare of economies and society. Thus, core legal disciplines are exploring the effects of the financial crisis on social rights, labour market regulations, and civil, common law or international law, among others. With no doubt, the economic crisis has deeply impacted our economic, social, political and legal environment. During the last decade, researchers from a wide range of disciplines have been looking for solutions. Now it is time make a side stop on the way and to gather results. The 1rst International SBRLab Conference, Finding solutions for a post-crisis society, is organized by the Social and Business Research Lab (SBRLab), Universitat Rovira i Virgili. It is as an international and virtual meeting point of interdisciplinary research and researchers. The purpose of this international conference is to bring together researchers from management, economics, political, social and legal disciplines in order to present and discuss new trends in their respective fields.

Although the enterprise is increasingly expected to be socially responsible, in actuality extreme worker inequalities and social dumping have become ubiquitous worldwide. This volume – the first to focus attention on the ‘theory of the firm’ as it reveals itself in today’s world from a multidisciplinary perspective – underscores the necessity to rebuild a new scientifically controlled paradigm that acknowledges and regulates the dimension of power in the functioning of the organization. In their contributed essays, nineteen renowned scholars in labour law and industrial relations rethink the firm, its conception, its value, and its regulation, analysing such aspects as the following: – labour-management relations issues that arise when companies go global but workers remain local; – the firm as a social construction; – the continuing necessity for collective bargaining; – concealment of the employment relationship under the guise of self-employment; – concealment of the real employer behind figureheads and shell companies; – social welfare effects of outsourcing; – the company’s interaction with the network of suppliers and with local education processes; – determining who actually carries responsibility towards workers; – overcoming companies’ drive to enter the global market in response to national regulation; – realizing the notion of ‘duty of care’; – mechanisms of participation of workers in the management of the enterprise; and – the persistent limitations that women face in the workplace, even when worker participation is advocated. Based on studies of a range of countries in the Global South, this book examines heterogeneity within informal work by applying a common conceptual framework and empirical methodology. The country studies use panel data to study the dynamics of worker transitions between formal and heterogeneous informal work and present a comparative perspective across developing countries in Asia, Latin America, Sub-Saharan Africa, and North Africa and the Middle East. Each study provides a nuanced view of informality, dividing workers into six work statuses: formal wage-employees, upper-tier informal wage-employees, lower-tier informal wage employees, formal self-employed, and upper-tier informal self-employed. Based on this common conceptual framework, the country studies examine the distribution of workers across each of these work statuses, and document transition patterns across different formality and work statuses. The panel data analysed in each country study provide a basis for making statements about labour market transitions that are not warranted when using comparable cross-sections. The studies also examine the individual- and household-level characteristics associated with workers in each work status. Using these characteristics, each study constructs a 'job ladder' that ranks each work status, and then examines the characteristics of workers that are associated with transitions up (and down) the job ladder.

This has made it more difficult to discuss, and problematise, issues like vulnerability in employment in such terms as unfairness, inequality and inadequate protection. Taking the ‘deconstruction of employment’ as a central idea for theorising the phenomenon of work today, this volume explores the emergence of new semantic fields and territories for understanding and regulating employment. These new linguistic categories have implications beyond language alone: they reformulate the very concept of waged employment (including those aspects previously considered intrinsic to the meaning of work and of being ‘a worker’), along with other closely associated categories such as unemployment, self-employment, and inactivity.
