Book excerpt: This report details the British Columbia Attorney General's views regarding the Information & Privacy Commissioner's review of the implications of the United States Patriot Act for the personal information of British Columbians. The report focusses on the following issues identified by the Commissioner: whether the Act permits US authorities to access British Columbians' personal information that is, through the outsourcing of public services, in the custody or control of US-linked private-sector service providers; the conditions under which such access could occur; implications for public body compliance with the personal privacy protection provisions of the Freedom of Information & Protection of Privacy Act; and measures to eliminate or mitigate privacy risks affecting compliance with the latter Act. Matters discussed in the report include: existing information-sharing & access mechanisms between the US & Canada, including the Mutual Legal Assistance Treaty; the provincial legal framework related to protection of privacy & freedom of information; the risk of access to Canadian information under the Patriot Act; trade & investment obligations arising under international agreements; other security risks related to information disclosure; and privacy protection measures. Appendices include examples of effective mitigation strategies and a copy of the Commissioner's guidelines for data services contracts.

Book excerpt: Revision of the legislation may amount to a relaunching of the tort of invasion of privacy in the province. [...] Although the court found that the hospital had breached a statutory duty to maintain the confidentiality of medical records,18 it found no violation of The Privacy Act: On the facts as presented, it cannot be said the hospital "wilfully and without claim of right" violated the privacy of the plaintiff. [...] The Attorney General of the province explained that the legislation was "worded in such a way as to leave the legal definition of privacy in a specific case to the discretion of the court." See British Columbia Law Institute, Consultation Paper on the Privacy Act of British Columbia (July 2007) at 4, n 15. [...] The tort of invasion of privacy: Theory and practice Although legislators have recently favoured the comprehensive code approach of statutes such as The Freedom of Information and Protection of Privacy Act, the potential value of a general tort of invasion of privacy has once again begun to be recognized. [...] In Roth v Roth, an Ontario court similarly found harassment to be an actionable invasion of privacy, holding that "whether the invasion of privacy of an individual will be actionable will depend on the circumstances of the particular case and the conflicting rights involved."53 In January, 2012, the Ontario Court of Appeal confirmed the existence of the tort of intrusion upon seclusion (invasion o.

Book Consultation Paper on Assisted Living in British Columbia

Download or read book Consultation Paper on Assisted Living in British Columbia written by British Columbia Law Institute and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In conjunction with a volunteer project committee of experts and volunteers experienced with assisted-living issues, the British Columbia Law Institute and its division the Canadian Centre for Elder Law have developed this consultation paper covering a broad range of assisted-living issues. The consultation paper is published in conjunction with the Assisted Living BC Project. This BCLI/CCEL joint project, which began in 2009, is designed to review the legislative framework for assisted living in British Columbia and identify changes to the framework that would be beneficial as assisted living continues to develop in this province. The project focusses on the Community Care and Assisted Living Act, the principal act that regulates assisted living in British Columbia, but touches on other applicable legislation and policy. The project was undertaken following the publication of Assisted Living: Past, Present and Future Legal Trends in Canada, a research study by CCEL that examined and compared the legal and regulatory frameworks for assisted living and its equivalents across Canada. That study pointed to various gaps and areas of uncertainty that suggested a law-reform project focussing on assisted living in British Columbia would be worthwhile. The Assisted Living BC Project examines the legal framework for assisted living from various perspectives: the nature and legal definition of assisted living; housing and tenancy issues; consumer rights (including the relative merits of having a residents' bill of rights); privacy; health and safety; employment and labor relations; dispute resolution; and different regulatory approaches that could be employed.

Book Reasonable Expectations of Privacy

Download or read book Reasonable Expectations of Privacy written by Sjaak Nouwt and published by Cambridge University Press. This book was released on 2005-07-28 with total page 392 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1967, Justice John Marshall Harlan introduced the litmus test of ‘a reasonable expectation of privacy’ in his concurring opinion in the US Supreme Court case of Katz v. United States. Privacy, regulations to protect privacy, and data protection have been legal and social issues in many Western countries for a number of decades. However, recent measures to combat terrorism, to fight crime, and to increase security, together with the growing social acceptance of privacy-invasive technologies can be considered a serious threat to the fundamental right to privacy. What is the purport of ‘reasonable expectations of privacy’? Reasonable expectations of privacy and the reality of data protection is the title of a research project being carried out by TILT, the Tilburg Institute for Law, Technology, and Society at Tilburg University, The Netherlands. The project is aimed at developing an international research network of privacy experts (professionals, academics, policymakers) and to carry out research on the practice, meaning, and legal performance of privacy and data protection in an international perspective. Part of the research project was to analyse the concept of privacy and the reality of data protection in case law, with video surveillance and workplace privacy as two focal points. The eleven country reports regarding case law on video surveillance and workplace privacy are the core of the present book. The conclusions drawn by the editors are intended to trigger and stimulate an international debate on the use and possible drawbacks of the ‘reasonable expectations of privacy’ concept. The editors are all affiliated to TILT – Tilburg Institute for Law, Technology, and Society, Tilburg University, The Netherlands. This is Volume 7 in the Information Technology and Law (IT&Law) Series
