Book excerpt: In conjunction with a volunteer project committee of experts and volunteers experienced with assisted-living issues, the British Columbia Law Institute and its division the Canadian Centre for Elder Law have developed this consultation paper covering a broad range of assisted-living issues. The consultation paper is published in conjunction with the Assisted Living BC Project. This BCLI/CCEL joint project, which began in 2009, is designed to review the legislative framework for assisted living in British Columbia and identify changes to the framework that would be beneficial as assisted living continues to develop in this province. The project focusses on the Community Care and Assisted Living Act, the principal act that regulates assisted living in British Columbia, but touches on other applicable legislation and policy. The project was undertaken following the publication of Assisted Living: Past, Present and Future Legal Trends in Canada, a research study by CCEL that examined and compared the legal and regulatory frameworks for assisted living and its equivalents across Canada. That study pointed to various gaps and areas of uncertainty that suggested a law-reform project focussing on assisted living in British Columbia would be worthwhile. The Assisted Living BC Project examines the legal framework for assisted living from various perspectives: the nature and legal definition of assisted living; housing and tenancy issues; consumer rights (including the relative merits of having a residents' bill of rights); privacy; health and safety; employment and labor relations; dispute resolution; and different regulatory approaches that could be employed.

It begins with background on the assisted living concept and the content of the Act. It then describes the types of services provided at an assisted living residence, the requirements of assisted living occupants, the oversight of assisted living facilities by the provincial Registrar, the guiding principles & design features of assisted living registration system development, the enforcement of standards, the reconsideration of registration decisions, appeal procedures, and matters outside the Registrar's scope. The appendix contains an example of personal assistance services provided in an assisted living residence.

The British Columbia Community Care & Assisted Living Act will protect consumer interests by requiring the registration of assisted living residences. The Act establishes that health & safety standards at an assisted living residence can be set out in regulation. This discussion paper provides draft minimum health & safety standards for registered assisted living residences. The standards cover such matters as staffing, requirements under other legislation, housing (including building design & maintenance, fire safety, & security), hospitality services such as laundry & meals, personal assistance service areas (including activities of daily living, medication administration, management of occupant cash or property, and rehabilitation programs), emergency preparedness, and complaint handling. The appendix includes guidelines related to standard practice tasks that may be performed by trained non-professional staff and professional tasks delegated to non-professional staff.

These concerns focus primarily around lack of understanding regarding patients' rights, lack of disclosure and information access regarding the residential system as a whole, and the lack of availability of information.
