Available in PDF, EPUB and Kindle. Book excerpt: The 1961 Vienna Convention on Diplomatic Relations has for over 50 years been central to diplomacy and applied to all forms of relations among sovereign States. Participation is almost universal. The rules giving special protection to ambassadors are the oldest established in international law and the Convention is respected almost everywhere. But understanding it as a living instrument requires knowledge of its background in customary international law, of the negotiating history which clarifies many of its terms and the subsequent practice of states and decisions of national courts which have resolved other ambiguities. Diplomatic Law provides this in-depth Commentary. The book is an essential guide to changing methods of modern diplomacy and shows how challenges to its regime of special protection for embassies and diplomats have been met and resolved. It is used by ministries of foreign affairs and cited by domestic courts world-wide. The book analyzes the reasons for the widespread observance of the Convention rules and why in the special case of communications - where there is flagrant violation of their special status - these reasons do not apply. It describes how abuse has been controlled and how the immunities in the Convention have survived onslaught by those claiming that they should give way to conflicting entitlements to access to justice and the desire to punish violators of human rights. It describes how the duty of diplomats not to interfere in the internal affairs of the host State is being narrowed in the face of the communal international responsibility to monitor and uphold human rights.

Download or read book The Law of Consular Access written by John Quigley and published by Routledge. This book was released on 2009-10-16 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past decade, there has been an explosion of litigation at the international and domestic levels concerning consular access for foreign nationals charged with a criminal offence. The issue has complicated relations between countries, with the majority of litigation involving the United States, which has adopted a restrictive view of the consular access obligation. This book brings together for the first time relevant documentary sources on the law of consular access. The book includes significant excerpts alongside commentary on the documents, allowing readers to draw their own conclusions. While presenting information on the Vienna Convention on Consular Relations, the book presents other sources, including bilateral consular agreements, multilateral treaties, and key court cases from various jurisdictions. Many of these sources are not readily accessible. The Law of Consular Access will be of interest to scholars of international law, human rights, and international relations. It will also be of interest to private and government lawyers, as well as diplomats and consuls.

Available in PDF, EPUB and Kindle. Book excerpt: Satow's Diplomatic Practice is a classic work, first published 90 years ago and revised four times since. This is the first revised edition for thirty years, during which time the world and diplomacy have changed almost beyond recognition. The new edition provides an enlarged and updated section on the history of diplomacy and revises comprehensively the practice of diplomacy and the corpus of diplomatic and international law since the end of the Cold War. It traces the substantial expansion in numbers both of sovereign states and international and regional organisations and features detailed chapters on diplomatic privileges and immunities, diplomatic missions and consular matters. It also examines new forms of diplomacy from the work of NGOs to the use of secret envoys and commercial security firms, and the book highlights the impact of international terrorism on the life and work of a diplomat. Satow is an indispensable guide for anyone working in or studying the field of diplomacy.

Book Diplomatic and Consular Law

Download or read book Diplomatic and Consular Law written by Ludwik Dembinski and published by Peter Lang Group Ag, International Academic Publishers. This book was released on 1992 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: The major international instruments relating to the status of diplomatic, consular, special and permanent missions of States and of their members are scattered in various official publications of the United Nations, of States parties to them, as well in some private editions. It is for the first time, however, that all of these documents are published in one single volume. This makes them now readily available to all those who may need to refer to them in their daily practice in Ministries of Foreign Affairs, in diplomatic missions and in international organizations. This book may also prove helpful to the growing number of experts representing States in many international bodies and conferences who enjoy the special status which for generations had been the exclusive privilege of career diplomats.
