Courts often cannot enforce their judgments and must rely on reputational sanctions to ensure compliance. One way to do this is for courts to improve their reputation for generating compliance with their judgments. When the court's reputation is increased, parties will be expected to comply with its judgments and the reputational sanction on a party that fails to comply will be higher. This strategy allows national and international courts, which cannot enforce their judgments against states and executives, to improve the likelihood that their judgments will be complied with over time. This book describes the judicial tactics that courts use to shape their judgments in ways that maximize their reputational gains.

Instead of selecting one overall best paper, we picked out four “distinguished” papers – though we were tempted to select at least 12 such papers. In addition we included 16 short papersin the proceedings– these were presentedas posters at CP 2004. This volume includes summaries of the four invited talks of CP 2004. Two speakers from industry were invited. However these were no ordinary industrial representatives,buttwoofthe leadingresearchersinthe CPcommunity:Helmut Simonis of Parc Technologies, until its recent takeover by Cisco Systems; and Jean Francoi ̧ s Puget, Director of Optimization Technology at ILOG. The other two invited speakers are also big movers and shakers in the researchcommunity.

Each paper received at least three reviews, which the authors had the opportunity to see and to react to, before the papers and their reviews were discussed extensively by the members of the Program Committee.

The fundamental challenge for interpreters of the Constitution is how to read that old document over time. In Fidelity & Constraint, legal scholar Lawrence Lessig explains that one of the most basic approaches to interpreting the constitution is the process of translation. Indeed, some of the most significant shifts in constitutional doctrine are products of the evolution of the translation process over time. In every new era, judges understand their translations as instances of "interpretive fidelity," framed within each new temporal context. Yet, as Lessig also argues, there is a repeatedly occurring countermove that upends the process of translation. Throughout American history, there has been a second fidelity in addition to interpretive fidelity: what Lessig calls "fidelity to role." In each of the cycles of translation that he describes, the role of the judge -- the ultimate translator -- has evolved too. Old ways of interpreting the text now become illegitimate because they do not match up with the judge's perceived role. And when that conflict occurs, the practice of judges within our tradition has been to follow the guidance of a fidelity to role. Ultimately, Lessig not only shows us how important the concept of translation is to constitutional interpretation, but also exposes the institutional limits on this practice. Here global optimization refers to ?nding the absolutely best feasible point, while constraint satisfaction refers to?ndingallpossiblefeasiblepoints.AsinCOCOS2002,the?rstsuchworkshop (see the proceeedings [1]), the emphasis was on complete solving techniques for problems involving continuous variables that provide all solutions with full rigor, and on applications which, however, were allowed to have relaxed standards of rigor. The participants used the opportunity to meet experts from global optimi- tion, mathematical programming, constraint programming, and applications, and to present and discuss ongoing work and new directions in the ?eld. Four invited lectures and 20 contributed talks were presented at the workshop. The invited lectures were given by John Hooker (Logic-Based Methods for Global Optimization), Jean-Pierre Merlet (Usual and Unusual Applications of Interval Analysis), Hermann Schichl (The COCONUT Optimization Environment), and Jorge Mor ́ e (Global Optimization Computational Servers). The mathematical tools for choosing these best combinations are exactly what is this book about. With the advent of computers and the computer-aided design the pro bations of the selected variants are usually performed not for the real examples ( this may require some very expensive building of sample op tions and of the special installations to test them ), but by the analysis of the corresponding mathematical models. The sophistication of the mathematical models for the objects to be designed, which is the natu ral consequence of the raising complexity of these objects, greatly com plicates the objective performance analysis. Today, the main (and very often the only) available instrument for such an analysis is computer aided simulation of an object's behavior, based on numerical experiments with its mathematical model.
