In particular, these articles shed light on whether the rule of law ideal is commensurable with government based on the Chinese Communist Party. Beginning virtually from scratch, China has established a comprehensive legal system that boasts a constitution, primary and secondary legislation and plentiful regulations covering most areas of public and private life. Yet, as these articles discuss, its courts are enmeshed in Party and state hierarchies and are not empowered to directly apply constitutional principles or rights, ensuring that the law is subordinate to national public policy goals. Legal and extra-legal methods for punishing wrongdoing and resolving disputes also raise questions of due process of law. Ultimately, the question is therefore whether China's legal system, if eschewing formalised human rights, is developing a capacity to protect fundamental human dignity.

A considerable body of literature has debated the due limits of the exercise of executive and legislative power, and discussions about legitimacy, democracy, and the adjudication of rights (civil and political, and socioeconomic) abound, yet scant attention has been paid by constitutional lawyers to the ways in which constitutions may protect and empower economic actors, and to how constitutions might influence the regulation and governance of specific markets. The contributors to this collection mobilize insights from other disciplines – including economic theory, history, and sociology – and consider the relationship between constitutional frameworks and bodies of law – including property law, criminal law, tax law, financial regulation, and human rights law – to advance understanding of how constitutions relate to markets and to the political economy. This book’s analysis of the role constitutions play in shaping markets will appeal to scholars and students in law, economics, history, politics, and sociology.

It was a center of modernizing Buddhism in the early twentieth century and a flagship for the revival of Buddhism after state suppression during the Cultural Revolution. The Space of Religion takes readers inside the Nanputuo Temple in order to explore the practice of Buddhism in modern China and the complex relationship between Buddhism and the Chinese state. Based on three decades of ethnographic research, Yoshiko Ashiwa and David L. Wank tell the story of Nanputuo against the backdrop of a dramatic stretch of Chinese history. They vividly depict episodes such as renovating the halls, reestablishing ties with overseas Chinese donors, conflicts with local government, revival of ritual life, reopening of its Buddhist academy, and the passion of the Guanyin birthday festival. To understand Nanputuo, Buddhist communities, and other temples in Xiamen, Ashiwa and Wank develop the concept of religion as a space constituted by physical, semiotic, and institutional dimensions. They also show how the Chinese state and Buddhism have each adapted to the other, as the temple has adjusted to government policy while the state has deployed Buddhism in its promotion of Chinese culture. This interdisciplinary book is both a theoretically generative analysis of religious spaces and an empirically rich account of the recovery of Buddhism in China after the Mao era.

Book excerpt: This book introduces the history of cultural exchanges between East Asia and the West through comparative biographical sketches of sixty personalities from China and Japan. These sketches illustrate how both countries, starting from a shared cultural heritage in script and Confucian, Buddhist, and Daoist worldviews, took rather different approaches in their encounters with the European world since the 16th to 17th centuries. In particular in the 19th century under external and internal pressure, both nations strove to modernize their societies by introducing technology and new ideas from the Western world, turning them into political rivals and even enemies. Thus, these biographical sketches also shed some light on the general dynamics of cross-cultural interactions between China, Japan, and the West up to the early 20th century. The Chinese and Japanese men and women presented in this book are outstanding personalities who tried to open up the road to international relationships, pioneers in their respective domains who introduced Western culture to their nations, precursors who strove for modernization, e.g., in the fields of translation, education, medicine, media, and social welfare. They testify to individual agency in these cross-cultural exchanges. Many of those who tried to be “cultural bridge-builders” since the 16th century were Christians, simply because the missionaries, who worked hard to learn the native languages of China and Japan, were the first to introduce new cultural elements to these countries. The universal scope and vision of the Christian faith enabled both missionaries and native believers to overcome narrow nationalism or xenophobia and turned them into cross-cultural mediators.
