Chapter 1 reviews Mexico's constitutional trajectory, and explains why democracy, republicanism, federalism, separation of state and church, protection of fundamental rights and the Nation's ownership of mineral resources first became constitutional principles. Chapters 2, 3, 4 and 5 deal respectively with democracy and the electoral system, and the legislative, executive and judicial branches of federal government. Chapter 6 introduces the institutional structure of Mexico's federal system, while Chapter 7 discusses the rules, principles and institutions for the protection of human rights. Chapter 8 examines the constitutional regime of Mexico's economy. The conclusion explains how a series of factors has combined to produce a gap between the formal Constitution and what can be seen as the living Constitution; bridging that gap presents Mexican politics and society with one of its great contemporary challenges.

Unlike most other new democracies in Latin America, no special Constitutional Court was set up, nor was there any designated bench of the Supreme Court for constitutional adjudication. Instead, the judiciary saw its powers expand incrementally. Under this new context inevitable questions emerged: How have the justices interpreted the constitution? What is the relation of the court with the other political institutions? How much autonomy do justices display in their decisions? Has the court considered the necessary adjustments to face the challenges of democracy? It has become essential in studying the new role of the Supreme Court to obtain a more accurate and detailed diagnosis of the performances of its justices in this new political environment. Through critical review of relevant debates and using original data sets to empirically analyze the way justices voted on the three main means of constitutional control from 2000 through 2011, leading legal scholars provide a thoughtful and much needed new interpretation of the role the judiciary plays in a country’s transition to democracy This book is designed for graduate courses in law and courts, judicial politics, comparative judicial politics, Latin American institutions, and transitions to democracy. In 1834, the ruling elite of middle class hombres de bien concluded that a highly centralised republican government was the only solution to the turmoil and factionalism that had characterised the new nation since its emancipation from Spain in 1821. The central republic was thus set up in 1835, but once again civil strife, economic stagnation, and military coups prevailed until 1846, when a disastrous war with the United States began in which Mexico was to lose half of its national territory. This study explains the course of events and analyses why centralism failed, the issues and personalities involved, and the underlying pressures of economic and social change.

Book excerpt: This book is a radical reinterpretation of the process that led to Mexican independence in 1821—one that emphasizes Mexico's continuity with Spanish political culture. During its final decades under Spanish rule, New Spain was the most populous, richest, and most developed part of the worldwide Spanish Monarchy, and most novohispanos (people of New Spain) believed that their religious, social, economic, and political ties to the Monarchy made union preferable to separation. Neither the American nor the French Revolution convinced the novohispanos to sever ties with the Spanish Monarchy; nor did the Hidalgo Revolt of September 1810 and subsequent insurgencies cause Mexican independence. It was Napoleon's invasion of Spain in 1808 that led to the Hispanic Constitution of 1812. When the government in Spain rejected those new constituted arrangements, Mexico declared independence. The Mexican Constitution of 1824 affirms both the new state's independence and its continuance of Spanish political culture.

Book excerpt: Although they are not directly accountable to voters, constitutional court judges communicate with the general public through the media. In Judicial Power and Strategic Communication in Mexico, Jeffrey K. Staton argues that constitutional courts develop public relations strategies in order to increase the transparency of judicial behavior and promote judicial legitimacy. Yet, in some political contexts there can be a tension between transparency and legitimacy, and for this reason, courts cannot necessarily advance both conditions simultaneously. The argument is tested via an analysis of the Mexican Supreme Court during Mexico's recent transition to democracy, and also through a cross-national analysis of public perceptions of judicial legitimacy. The results demonstrate that judges can be active participants in the construction of their own power. More broadly, the study develops a positive political theory of institutions, which highlights the connections between democratization and the rule of law.

The United States is a nation in which speakers of minority languages were conquered or incorporated and the languages spoken by them were suppressed or neglected. Since the 1960’s, the United States and its territories have seen a resurgence of claims for language recognition by minority groups representing a considerable population (Spanish in Puerto Rico and the Southwestern states, Chamorro in Guam, Chamorro and Carolinian in the Northern Mariana Islands, and Samoan in American Samoa). Also, the book studies recent developments regarding the status and use of English in the United States and some of its territories. For example, studying the effects of legal, social, educational, and political contexts on the Spanish language in the Southwestern states, and Pacific languages (Chamorro, Carolinian, and Samoan) in Guam, the Northern Mariana Islands, and American Samoa, reveals that English continues to be used as the main language of communication in all these places despite continuous efforts to protect the rights of indigenous languages by their native populations. For these reasons, it is important to compare the linguistic laws promulgated in the constitutions and statutes of the United States and its territories, or the lack thereof, as a response to the demands for linguistic rights by sectors of the population who do not speak English as a first language or who may seek to maintain the use of one or more indigenous languages. The book offers insights to those in charge of drafting legislation in the area of language rights. It shows how the United States and its territories could recognize and accommodate linguistic diversity.

They describe their approach as "constitutional fidelity"--not to how the Framers would have applied the Constitution, but to the text and principles of the Constitution itself.
