Parmi elles, la justice des mineurs occupe désormais une place centrale. L'analyse du contentieux comparé des droits et libertés du mineur délinquant met ainsi en lumière la consécration de principes et d'une philosophie analogues au sein des systèmes français, espagnol et nord-américain. Ces derniers forment la substance d'un cadre constitutionnel commun, composé de principes ''sur mesure'' et porteur d'une orientation éducative et protectrice. Ils attestent l'existence d'un contrôle de constitutionnalité adapté aux particularismes liés à la condition de minorité. Toutefois, l'efficacité de ce cadre fait désormais l'objet d'une remise en cause. Alors qu'il devait a priori renforcer le contrôle juridictionnel de constitutionnalité des lois relatives à la lutte contre la délinquance juvénile, il apparaît insuffisant à prévenir l'infléchissement législatif des particularismes de la matière. Dans le contexte sécuritaire tendu qui irrigue désormais la plupart des démocraties libérales, l'étau de constitutionnalité subit un relâchement significatif et les principes composant le cadre constitutionnel de la justice des mineurs ne bénéficient pas toujours d'un degré de protection suffisant à assurer l'efficacité de sa philosophie humaniste. La matière se trouve dès lors soumise aux flux et reflux idéologiques du pouvoir politique. Plus largement, l'étude entend illustrer les difficultés rencontrées par les juges chargés de réaliser le contrôle de constitutionnalité lorsqu'il s'agit d'opérer la conciliation entre sécurité et liberté

Ainsi apparaît la notion de minorité. Cette notion influence la construction de la justice pénale des mineurs délinquants en appelant, à l'instar de droit commun, un ensemble de principes directeurs qui correspondent à la minorité et ont pour but la protection des mineurs. Cette justice se forme et fonctionne sur la base des principes directeurs. Ceux-ci constituent ainsi un bloc rationnel et font émerger une autonomie indépendante de la justice pénale des majeurs délinquants. Ces principes directeurs peuvent être classés en deux catégories, l'une relative à l'émergence de principes directeurs spécifiques et l'autre, aux aménagements des principes directeurs de droit commun. Nous pouvons classer les sources de ces principes directeurs en deux catégories. L'une concerne le droit international, l'autre, le droit interne. Pour la source internationale, nous pouvons évoquer la Déclaration universelle des droits de l'homme et le Pacte international relatif aux droits civils et politiques du 16 décembre 1966 (PIDCP) sans pour autant oublier la Convention internationale des droits de l'enfant du 26 janvier 1990 (CIDE). S'agissant de la source nationale, l'ordonnance du 2 février 1945 relative à l'enfance délinquante en constitue une, puisque la justice pénale des mineurs délinquants repose actuellement sur cette ordonnance. La jurisprudence du Conseil constitutionnel en constitue une autre source nationale.

Book excerpt: La justice des mineurs en Côte d'Ivoire et en France s'est cristallisée à partir d'un texte majeur : l'ordonnance du 2 février 1945 considérée comme la charte de l'enfant délinquant. Les principes qu'elle énonce ont permis d'élaborer dans les deux pays, l'ensemble de la législation pénale sur l'enfant auteur d'infraction. Trois parmi eux paraissent essentiels : à savoir la rééducation et la réinsertion, la spécialisation, et la continuité de l'intervention. Telle qu'elle se présente, la justice pénale se caractérise par un renversement des perspectives par rapport au droit commun. En ce sens, le mineur reconnu coupable d'infraction n'est justiciable que des juridictions spéciales. Mais, cela ne signifie pas que le législateur ivoirien et son homologue français ont légiféré très exactement de la même façon en matière de droit pénal des mineurs. Si en France, les réformes de la législation relative à la minorité ont permis une amélioration du statut de l'enfant délinquant et un renouvellement significatif des réponses à la délinquance des jeunes, il n'en va pas de même en Côte d'Ivoire. Aucune réforme n'a été enregistrée depuis 1981. Ainsi, les juridictions sont-elles réduites à se contenter de quelques dispositions du code pénal et du code de procédure pénale (). Le pénal réinvestit ainsi le champ de la délinquance des mineurs (...).
