Book excerpt: Fifty years ago, academics and policymakers throughout the world agreed that it was impossible for certain sets of historically antagonistic groups to coexist peacefully on a long-term basis. This book examines the system of consociation, which was identified by Arend Lijphart and ended that pessimistic consensus. Lijphart’s specific observations concerning the impact of consociation are assessed quantitatively and qualitatively, facilitated through careful operationalization of his descriptions of consociation’s four components: grand coalition, minority veto, proportionality, and segmental autonomy. Insights derived from a dataset representing the experiences of eighty-eight countries are examined further through case study analysis of the seven societies most often discussed in relation to consociation: Austria, Belgium, Canada, the Netherlands, Northern Ireland, South Africa, and Switzerland. The components of consociation are found to promote lasting peace in divided societies most successfully when combined with additional incentives for the encouragement of cross-cutting cleavages and shared loyalties.

Book excerpt: Departing from the established literature connecting the political-institutional patterns of democracy with the quality of democracy, this book acknowledges that democracies, if they can be described as such, come in a wide range of formats. At the conceptual and theoretical level, the authors make an argument based on deliberation, redrawing power diffusion in terms of the four dimensions of proportionality, decentralisation, presidentialism and direct democracy, and considering the potential interactions between these aspects. Empirically, they assemble data on sixty-one democracies between 1990 and 2015 to assess the performance and legitimacy of democracy. Their findings demonstrate that while, for example, proportional power diffusion is associated with lower income inequality, there is no simple institutional solution to all societal problems. This book explains contemporary levels of power diffusion, their potential convergence and their manifestation at the subnational level in democracies including the United States, Switzerland, Germany and Austria.

Current examples include Belgium, Bosnia, Northern Ireland, Burundi, and Iraq. Despite their growing popularity, they have begun to be challenged before human rights courts as being incompatible with human rights norms, particularly equality and non-discrimination. Courts and Consociations examines the use of power-sharing agreements, their legitimacy, and their compatibility with human rights law. Key questions include to what extent, if any, consociations conflict with the liberal individualist preferences of international human rights institutions, and to what extent consociational power-sharing may be justified to preserve peace and the integrity of political settlements. In three critical cases, the European Court of Human Rights has considered equality challenges to important consociational practices, twice in Belgium and then in Sejdic and Finci v Bosnia regarding the constitution established for Bosnia Herzegovina under the Dayton Agreement. The Court's decision in Sejdic and Finci has significantly altered the approach it previously took to judicial review of consociational arrangements in Belgium. This book accounts for this change and assess its implications. The problematic aspects of the current state of law are demonstrated. Future negotiators in places riven by potential or actual bloody ethnic conflicts may now have less flexibility in reaching a workable settlement, which may unintentionally contribute to sustaining such conflicts and make it more likely that negotiators will consider excluding regional and international courts from reviewing these political settlements. Providing a clear, accessible introduction to both the political use of power-sharing settlements and the human rights law on the issue, this book is an invaluable guide to all academics, students, and professionals engaged with transitional justice, peace agreements, and contemporary human rights law.

Soon after Arend Lijphart and Gerhard Lehmbruch had depicted consociational democracy as a viable alternative to majoritarian forms of democracy, a fierce debate about its wider applicability took root. Lijphart and Lehmbruch had presented the Netherlands, Belgium, Austria and Switzerland as cases of consociational democracies - but would the concept work in countries that are divided more deeply? For a good reason, the issue regained relevance and interest of scholars during the 1990s: Intra-state wars now took their tolls on an unprecedented scale - many of which had an ethnic dimension. It requires no statistical analysis to acknowledge ethnic divisions as one of the most serious sources of today's violent conflicts. In this context, it has been asked whether consociational democracy is a suitable and appropriate model to accommodate the diverse interests and cultures of groups in a multiethnic society. Is it a sustainable model able to prevent conflicts from turning violent? Should it be part of peacebuilding efforts in a post-conflict society? A recurrent proposition advanced in this book is that Lebanese sectarian consociationalism has been both a cure and a curse in the formulation of political settlements and institution building. On the one hand, and in contrast to many surrounding Arab regimes, consociational arrangements have provided the country with a relative democratic political life. A limited government with a strong confessional division of power and a built-in checks and balance mechanism prevented the emergence of dictatorship or monarchy. On the other hand, a chronic weak state has complicated efforts for nation building in favour of sectarian fragmentation, external interventions, and strong polarization that periodically brought the country to the verge of total collapse and civil war. While examining Lebanese sectarian politics of conflict and concession during different historic junctures many revelations are made that underlie the role of domestic and international forces shaping the country’s future. Presenting an implicit description of the power and functions of the various branches of government within the context of sectarian consociationalism, this book is an important introductory text for students of Lebanese Politics and Middle Eastern politics more broadly.
