Book excerpt: The concepts of popular consent and limit as applied to the exercise of political authority are fundamental features of parliamentary democracy. Both these concepts played a role in medieval political theorizing, although the meaning and significance of political consent in this thought has not been well understood. In a careful, scholarly, and readable survey of the major political texts from Augustine to Ockham, Arthur Monahan analyses the contribution of medieval thought to the development of these two concepts and to the correlative concept of coercion. In addition, he deals with the development of these concepts in Roman and canon law and in the practices of the emerging states of France and England and the Italian city- states, as well as considering works in legal and administrative theory and constitutional documents. In each case his interpretations are placed in the wider context of developments in law, church, and administrative reforms. The result is the first complete study of these three crucial terms as used in the Middle Ages, as well as an excellent summary of work done in a number of specialized fields over the last twenty-five years.

The essays in this volume reveal a previously unexplored dynamic relationship between the authors of the three nations, explaining the intimate connection between ruler and ruled.

Marshall.The Supreme Court's 1982 plurality decision in Northern Pipeline Construction Co. v. Marathon Pipe Line Co. remains one of the most controversial bankruptcy decisions in the Court's history. Northern Pipeline limited Article I bankruptcy courts' authority to hear and decide disputes that fall within the “core” of the bankruptcy power, but declined to provide much guidance concerning the parameters of these bankruptcy-specific “public rights.” Scholars and practitioners who expected the Court to abandon Northern Pipeline, however, were in for a rude awakening when the Court issued its decision in Stern v. Marshall in 2011. Writing for the majority, Chief Justice Roberts not only reaffirmed the constitutional limits of the Article I bankruptcy courts as outlined in Northern Pipeline, but also indicated that litigant consent is insufficient to overcome these limits.

This was recognized in an older tradition in public finance which can still serve as a starting point for modern work. The contributors to the volume recognize this tradition, but add to it by using contemporary frameworks to study a set of related issues concerning fiscal coercion and economic welfare. These issues range from the compatibility of an open access society with the original Wicksellian vision to the productivity of coercion in experimental games.
