La confidentialité souhaitée pour chaque type d'information est définie par un dispositif législatif important auquel se sont ajoutées les mesures portées par la loi relative aux droits des malades et à la qualité du système de santé en 2002. Ces nouvelles dispositions législatives ont bien été appliquées dans le domaine des données à caractère personnel en santé. Elles ont permis l'expansion du Dossier Pharmaceutique et des réseaux de santé, tout en garantissant la protection des données personnelles des patients. En revanche, les lois imposant un agencement plus respectueux de l'intimité des personnes et notamment un espace de confidentialité fermé ne se sont pas traduites par des faits concrets. Le manque de confidentialité dû aux problèmes d'agencement est d'ailleurs rapporté par les patients, en particulier ceux présentant une pathologie lourde, ou encore, par le jeune public. Le manque de place est la principale raison avancée par les officinaux pour justifier ce manquement à la loi. Pourant, les nouvelles missions confiées aux officinaux par la loi " Hôpital, Patients, Santé et Territoires " (HPST) sont subordonnées, elles aussi, à l'existence d'un espace de confidentialité dans les officines. Des solutions concrètes restent donc à définir dans ce domaine. Mais le respect de l'intimité des personnes à l'officine n'est pas qu'une question de sécurisation des circuits de l'information. Il est aussi dépendant de la relation que le pharmacien parvient à créer avec ses patients. Le pharmacien doit trouver dans chaque échange la juste distance avec la personne qu'il sert, afin de lui offrir le service pharmaceutique le plus adapté possible.
