Book excerpt: In 1511, a Portuguese expedition under the command of Afonso de Albuquerque arrived on the shores of Malacca, taking control of the prosperous Malayan port-city after a swift military campaign. Portugal, a peripheral but then technologically advanced country in southwestern Europe since the latter fifteenth century, had been in the process of establishing solid outposts all along Asia's litoral in order to participate in the most active and profitable maritime trading routes of the day. As it turned out, the Portuguese presence and influence in the Malayan Peninsula and elsewhere in continental and insular Asia expanded far beyond the sphere of commerce and extended over time well into the twenty-first century. Five hundred years later, a conference held in Singapore brought together a large group of scholars from widely different national, academic and disciplinary contexts, to analyse and discuss the intricate consequences of Portuguese interactions in Asia over the longue duree. The result of these discussions is a stimulating set of case studies that, as a rule, combine original archival and/or field research with innovative historiographical perspectives. Luso-Asian communities, real and imagined, and Luso-Asian heritage, material and symbolic, are studied with depth and insight. The range of thematic, chronological and geographic areas covered in these proceeding is truly remarkable, showing not only the extraordinary relevance of revisiting Luso-Asian interactions in the longer term, but also the surprising dynamism within an area of studies which seemed on the verge of exhaustion. Book excerpt: This book explores and analyzes developments in the military institution, military engagements as well as the larger security environment of (including non-war violence and maritime regions linking to) the Portuguese Empire in India. These developments occurred under the onslaught of the early modern globalization. The research shows that far from being dilapidated or archaic, the Portuguese colonial military there kept up with some developments in technology and organization in a competitive environment. Although the colonial military was not the most important reason in accounting for the survival of the Portuguese Estado da Índia, nor was the military profession the most lucrative occupation, the Portuguese experience gave indication of how a colonial state and society was able to survive against coalescing threats from the position of weakness. Located in the period and geographical region of the wax and waning of the Mughal and Maratha empires, Portuguese India was not necessarily a more violent place than the surrounding territories although resistance to and uprising against the Portuguese was usually underestimated. Beginning from the attempt at political and military centralization (and standardization) in the eighteenth century, the abolition of the army of the Estado da Índia in the nineteenth marked nominally the end of an era that may have a reverberation on the pacifist perception of Goa today.

Written as a historical ethnography, it explores the evolving shape of a series of Catholic festivals that took place throughout the duration of Portuguese colonial rule in Goa (1510–1961), and for which the centrepiece was the 'incorrupt' corpse of São Francisco Xavier (1506–52), a Spanish Basque Jesuit missionary-turned-saint. Using distinct genres of source materials produced over the long duree of Portuguese colonialism, the book documents the historical and visual transformation of Xavier’s corporeal ritualisation in death through six events staged at critical junctures between 1554 and 1961. Xavier’s very mutability as a religious, political and cultural symbol in Portuguese India will also suggest his continuing role as a symbol of Goa’s shared past (for both Catholics and Hindus) and in shaping Goa’s culturally distinct representation within the larger Indian nation-state.

The Shrutis (that which was heard) and the Smritis (that which was remembered) reflected this Vedic wisdom. Thinkers and philosophers of the time expressed their thoughts in prosaic Dharmasutras and later on in more refined poetic Dharmashastras. The Smritkars followed with their own interpretation, symbolically represented by the Code of Manu. That jurisprudence was responsible for taking the country through the Golden pages of its history. With the British dominance, India was plunged in Common Law Jurisprudence, interwoven with Hindu Philosophy. The Midnight country awoke in 1947 to an Independent democratic set up, and in 1950 was wedded to the Indian Constitutional philosophy, laid with the bricks of Common Law. With the establishment of the Supreme Court of India, the apex judicial institution in an interpretative mood carved a unique niche for Anglo- Indian Jurisprudence , amidst the Legal Systems of the World. In the twenty first century, India is on a launch pad as a new political and economical superpower. At this stage there is a need for India to familiarize with the Civil Law System, that has grip on the other half of the commercial world. Tiny pockets in Western and in Eastern India , as parts of erstwhile Portuguese or French colonial possessions had earlier experienced the Continental Jurisprudence. These pockets have the unique distinction of having run both the Common and Civil Law Systems and even simultaneously during the transition period . This experience can be a contribution to the globalizing world . Hence it is necessary to foster the study of Civil Law in India , not only from its historical past but also from its future prospects in world market. In “ Civil Law Studies: An Indian Prospective”, about two dozen scholars from the Law faculties of the Universities of India, Lisbon and Coimbra have collaborated to visualize the role for Civil Law Studies in the subcontinent . They have explored the different branches of law for comparative research such as constitutional, civil, commercial, criminal, etc. The book is intended to be a thought provoking exercise which will strengthen the Study and Research of Civil Law in India. The suggestions are meant to empower legal educators, law students , the bar and the bench in India.
