Book The Role of Fraternity in Law

Download or read book The Role of Fraternity in Law written by Adriana Cosseddu and published by Routledge. This book was released on 2021-12-05 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.

Book You Must Know Your Constitution

Download or read book You Must Know Your Constitution written by Fali S. Nariman and published by Hay House, Inc. This book was released on 2024-01-02 with total page 365 pages. Available in PDF, EPUB and Kindle. Book excerpt: 26 November 1949 marks the date when the longest constitution in the world was formally adopted to guide the largest democracy in the world. It effectively transformed the British Dominion of India into one nation—the independent Republic of India. The supreme law of the land set forth the workings of Indian democracy and polity, and its provisions aimed to secure justice, liberty, equality, and fraternity for the people of India. As drafted and as conceived, the constitution makes provision for a functioning democracy and not an electoral autocracy, and this is how it has to be worked. It is therefore imperative for all citizens to familiarise themselves with its provisions. In this definitive tome, the author (who commenced his legal practice in the year the constitution was enacted) presents his comments in a style that is comprehensive, lucid, and systematic. The book traces the history and the origins of India’s document of governance and explains its provisions. Some of the salient features of the book include: • An educative and informative exposition of the different parts of the Indian Constitution, including a bird’s-eye view of—and with comments on—all the three hundred and ninety-five articles of the constitution and additions made by constitutional amendments. • Provides references of critical cases and prominent constitutional developments up to 31 July 2023. • Insightfully describes the structure, powers, and directive principles of government institutions. • Contains updated judicial pronouncements and legislative and constitutional amendments. In essence, You Must Know Your Constitution is an immensely readable and insightful compendium, inter alia, for judiciary aspirants, academicians, legal and administrative authorities, policymakers, research scholars, and students as well as for general readers who are interested in exploring the manifold facets of India’s core document of governance.

Book A Brief History of Citizenship

Download or read book A Brief History of Citizenship written by Derek Heater and published by NYU Press. This book was released on 2004-07-07 with total page 159 pages. Available in PDF, EPUB and Kindle. Book excerpt: From Plato to Rorty, A Brief History of Citizenship provides a concise survey of the idea of citizenship. All major periods are covered, beginning with Greece and Rome, continuing on to the Middle Ages, the American and French Revolutions, and finally to the modern era. Heater effectively argues that we cannot begin to understand our current conditions until we have an understanding of the initial idea of "the citizen" and how that idea has evolved over the centuries. Important topics covered include how citizenship differs from other forms of sociopolitical identity, the differences between nationality and citizenship, and how multiculturalism has changed our ideas of citizenship in the twenty-first century. This concise and readable book is an ideal introduction to the history of citizenship.
