It includes a digest of all of the five volumes of Judge Cofiey 's valuable decisions. It in cludes many notes from California Supreme Court decisions reported prior to volume 148 of the California Reports which were not included in Green's Digest. The Table of Cases is also amendatory as well as supplementary, and contains a large number of California cases prior to 148 California which were not in cluded in Green's Digest. It will also be noted that in both digest and Table of Cases, cases contained in Green's Digest have been reprinted merely to correct errors. The form, however, is the same as that of Green's Digest. The same classi fications and analyses have been adopted and even the same section numbers have been preserved. The object of this scheme is to enable one to turn at a glance from any given collection of cases in Green's Digest to the more recent cases dealing with the particular subdivision of the subject under investigation. Wherever it was not possible to clmfiy a digest note under a section number found in Green's Digest, a new heading has been made which has been given a new number - usually by amxing the fraction Painstaking efiort has been exercised, however, to place these new sections in the most appropriate positions - that is to say, nearest the most similar section heading. Indeed, many, if not most, of these new sections are but subdivisions or subheads under the main section headings as they appear in Green's Digest. The opinions of the court are in all cases given, as they have been printed by the authorized Reporters, after correcting such errors of the press, or of citation, as a careful examination of the text has disclosed. I have endeavored to give in the head notes, the substance of each decision. They are designed to show the points decided by the court, not the dicta or reasoning of the judges. The statements of the cases have been made as brief as pos sible. For many years, it has been the habit of all the judges of this court, to set forth in their opinions, the facts of the cases, as the court viewed them, in making their decision. Such a statement, when complete, renders any other superfluous. When not found complete, I have not attempted to restate the whole case, but have supplied, in the report, such facts, or documents, as seemed to me to be wanting. In some cases, turning upon questions, or complicated states of fact, and not involving any matter of law, I have not thought it necessary to encumber the work with detailed statements of evidence, which no one would find it useful to recur to.
