Book Smart Contracting for Local Government Services

Download or read book Smart Contracting for Local Government Services written by Kevin Lavery and published by Bloomsbury Publishing USA. This book was released on 1999-03-30 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Privatization of local government is making headlines throughout the world. Scottsdale, Arizona, contracts for fire protection; Baltimore, to run nine city schools; and Chicago and Philadelphia for a range of services from janitors to recreational facilities. The United Kingdom, New Zealand, and Australia have arguably gone further than the United States. But much of the debate on contracting has been high on politics, philosophy, and emotion with little attention to practical issues of how to do contracting well. The book shifts the debate away from the politics and rhetoric to the practicalities and realities of contracting. The book is concerned with four issues—the role of contracting in government, the appropriateness of different contracting strategies, the process of contracting, and who does the contracting. Drawing on examples in the United States and the United Kingdom, the author considers the historical and cultural context of contracting, where contracting works and where it doesn't, the features of smart contracting, and the conditions that are conducive to smart contracting. The book provides an invaluable guide to those concerned with the practicalities of contracting.

Book Government Contracts

Download or read book Government Contracts written by Nicholas Seddon and published by . This book was released on 2013 with total page 509 pages. Available in PDF, EPUB and Kindle. Book excerpt: Government Contracts 5th edition is the new edition of a work that has now been in existence for some seventeen years. It is Australia's definitive legal text on all levels of government contracting, which focuses on the legal issues that may arise in connection with government contracts and which have no parallel in the private sector. It explains the law in a manner that government contract managers, and their private sector counterparts doing business with government, will find indispensable. Presented in plain English, it is equally accessible to lay readers and lawyers. Law students will also benefit from the up to date case law, relevant policy developments and legislation relating to government contracting, including procurement and outsourcing.Authoritative and respected, Government Contracts has been referred to in State and Federal court cases, in the High Court and in government policy documents.New material in this 5th edition includes:the application of, and exemption from, the Competition and Consumer Act 2010 (Cth) and the accompanying Australian Consumer Law to government at all three levels;a new section in Chapter 6 covers the application of the troublesome proportionate liability law to government at all levels;the impact of the High Court's decisions in Pape and Williams on the Commonwealth's spending power;coverage of the High Court's decision in Port of Portland Pty Ltd v Victoria;the anomalies created in New South Wales and Queensland by legislation that removes corporate status from local government bodies;treatment of tendering in Chapters 7 and 8 draws on new Australian case law and cases from other countries with similar legal systems to Australia, in particular Canada. As always with Seddon's work, a careful re-consideration of every aspect of the book has been undertaken providing clarity and comprehensive sources for the reader. This new edition is current to 30 November 2012 and is an indispensable resource for lawyers, government contract managers and their private sector counterparts. AUTHOR'S NOTE - LOCAL GOVERNMENT QUEENSLANDIn the Preface, Chapter 4 at [4.2] and Chapter 6 at [6.6] and [6.10], attention is drawn to the fact that Queensland local government bodies are not bodies corporate. This anomaly has now been corrected by an amendment that came into effect on 1 February 2013 - see Local Government Act 2009 (Qld) s 11.

Book The Separation Specification Dilemma in Contracting

Download or read book The Separation Specification Dilemma in Contracting written by Janine L. O'Flynn and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article draws on evidence from case studies of local government contracting in the Australian state of Victoria. It argues that one of the key elements of competitive tendering - the separation of purchasers from providers - undermines another of its essential mechanisms - the specification of services - at the point where previously in-house services are exposed to competition. The managers who are to become purchasers lack the requisite knowledge of services, which instead resides in the minds of the service delivery staff whose work is to be subjected to competitive processes. Separating purchasing from service-provision 'distances' the staff from the managers, impairing employees' willingness to share the relevant information. At the same time, the introduction of competition increases the probability that staff will withhold that knowledge, and makes it harder on probity grounds to maintain the type of collaborative relationship which might overcome their reluctance to share it.

Book Contracts and International Project Management

Download or read book Contracts and International Project Management written by David G. Carmichael and published by CRC Press. This book was released on 2000-01-01 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: Project Management has, as one of its essential ingredients, development, use, administration and management of contract. On any significant project here will be many players and stakeholders contractually linked. It is essential therefore that all project personnel be aware of contract matters. The difficulty with this for project personnel in the past, however, has been in finding a systematic and comprehensive coverage of contractual matters in the literature, written at an understandable lever. This book goes toward filling this void. This book focuses on the important issues of whether to contract out (outsource) work or do it in-house, on the numerous contractual payment options including bonuses and penalties, and on the delivery method or contractual relationships between project participants. This is provided in an international context, where project management takes on an added dimension related to differing practices and customs between countries. Numerous case studies and exercises are given to promote the understanding of the contractual and project management issues covered.

Book Australian Local Government

Download or read book Australian Local Government written by Brian Dollery and published by Macmillan Education AU. This book was released on 1997 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: The last few years have seen unprecedented change taking place in the Australian local government arena. In all states the functions and responsibilities of local authorities have been subjected to extensive reform. New legislation has redefined the role of councillors. Local governments have been required to introduce more efficient and effective management practices and become more open and responsive to their constituencies. The scope of traditional regulatory practices has been altered and councils forced to develop a competitive environment for the provision of services. The place of local authorities in the intergovernmental landscape has also changed. Different forms of interaction between Commonwealth, state and local government are evolving along with the emergence of new funding strategies to encourage a regional focus. This is the first book to offer a detailed discussion of the reforms that have taken place, and at the same time provide an informative and readable analysis for practitioners and students of government, politics and public sector management.
