Book Competition Law of the European Union

Download or read book Competition Law of the European Union written by Van Bael & Bellis and published by Kluwer Law International B.V.. This book was released on 2021-03-01 with total page 1618 pages. Available in PDF, EPUB and Kindle. Book excerpt: This new Sixth Edition of a major work by the well-known competition law team at Van Bael & Bellis in Brussels brings the book up to date to take account of the many developments in the case law and relevant legislation that have occurred since the Fifth Edition in 2010. The authors have also taken the opportunity to write a much-extended chapter on private enforcement and a dedicated section on competition law in the pharmaceutical sector. As one would expect, the new edition continues to meet the challenge for businesses and their counsel, providing a thoroughly practical guide to the application of the EU competition rules. The critical commentary cuts through the theoretical underpinnings of EU competition law to expose its actual impact on business. In this comprehensive new edition, the authors examine such notable developments as the following: important rulings concerning the concept of a restriction by object under Article 101; the extensive case law in the field of cartels, including in relation to cartel facilitation and price signalling; important Article 102 rulings concerning pricing and exclusivity, including the Post Danmark and Intel judgments, as well as standard essential patents; the current block exemption and guidelines applicable to vertical agreements, including those applicable to the motor vehicle sector; developments concerning online distribution, including the Pierre Fabre and Coty rulings; the current guidelines and block exemptions in the field of horizontal cooperation, including the treatment of information exchange; the evolution of EU merger control, including court defeats suffered by the Commission and the case law on procedural infringements; the burgeoning case law related to pharmaceuticals, including concerning reverse payment settlements; the current technology transfer guidelines and block exemption; procedural developments, including in relation to the right to privacy, access to file, parental liability, fining methodology, inability to pay and hybrid settlements; the implementation of the Damages Directive and the first interpretative rulings. As a comprehensive, up-to-date and above all practical analysis of the EU competition rules as developed by the Commission and EU Courts, this authoritative new edition of a classic work stands alone. Like its predecessors, it will be of immeasurable value to both business persons and their legal advisers.

Book European Union Competition Policy versus Industrial Competitiveness

Download or read book European Union Competition Policy versus Industrial Competitiveness written by Hikaru Yoshizawa and published by Routledge. This book was released on 2021-11-10 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines whether EU competition policy is applied fairly and consistently to EU and non-EU firms despite persistent political pressure from member states for a relaxation of the rules and deals with the dilemma of regional organisations in the global political economy. Focussing on the EU’s desire to achieve balance between the promotion of market competition and the enhancement of international competitiveness, the book explores the validity of its attempts successfully to ensure a ‘stringent competition policy’ which is nationality-blind and comparatively strict. Finally, it shows that the competition-competitiveness dilemma remains unresolved because the EU’s capability to set global regulatory standards is constrained by competition and the need to engage in multilateral forums, such as the WTO and the International Competition Network. This book will be of key interest to scholars and students of European Union studies, EU competition law and policy, EU external action and more broadly to global governance, international political economy and international relations.

Book Japanese Manufacturing Investment in Europe

Download or read book Japanese Manufacturing Investment in Europe written by Roger Strange and published by Routledge. This book was released on 2002-09-11 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: Japanese manufacturing investment in the European Community has grown dramatically over the last twenty years. At first, instances of investment were few, concentrated in a small number of industrial sectors. But since the mid-1980's there has been a surge of investment in a much wider range of industries. This volume details the growth of Japanese manufacturing investment in Europe in fourteen industrial sectors. The impact of Japanese competition and direct investment on European industries is considered in the context of the emergence of the three major trading blocs: the United States, Japan and the EC. Roger Strange concludes by making important policy recommendations, and arguing for the need for a new theoretical framework for assessing the political economy of foreign direct investment.

Book Competition in Energy Markets

Download or read book Competition in Energy Markets written by Peter D. Cameron and published by Oxford University Press, USA. This book was released on 2002 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent years have seen a major growth in the European law concerning the operation of the energy industry, especially with respect to electricity and gas. Several directives have been adopted that are aimed at the promotion of competition in this key sector of the European economy. At thesame time, the jurisprudence of the European Court had developed further on matters such as access to networks, import and export monopolies and security of supply. In this book the authors examine the principal legislation, Treaty provisions and decisions of the Court of Justice and Court of First Instance of the EU as they related to the promotion of competition in European energy markets. In particular, two chapters are devoted to a detailed analysis of theprovisions of the two directives that set out common rules for the creation of an internal market in the electricity and gas sectors. In each case, the analysis is set in the context of the various programmes of energy market liberalization and privatization in the Member States, which aresummarized in this book. However, the authors also take the wider pan-European context into account, explaining the requirements and the implications of the European Economic Area Agreement, the Energy Charter Treaty and the Europe Agreements with countries of Central and Eastern Europe. The approach adopted by the authors is both analytical and historical. They locate the legislation in the context of the EU Internal Market programme that began in the late 1980s and explain the roles played by the various parties (energy industries, consumers and EU institutions) in shaping thefinal legislation. Importantly, they explain how the framework character of the energy directives has led to further important rule-making in the implementation of the directives across the EU. They conclude that a co-ordinated response between the European Commission and the national regulatorswill be essential to resolve problems arising in the transition to a competitive energy market in the EU.

Book The Competitiveness of European Industry

Download or read book The Competitiveness of European Industry written by Arthur Francis and published by Taylor & Francis. This book was released on 2023-02-28 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1989, The Competitiveness of European Industry helps in developing our understanding of the process of improving and measuring industrial competitiveness. The contributors focus on the competitiveness of European industry. Three main topics are discussed: the concept of competitiveness itself; what can be learned about competitiveness at the level of an individual national economy; and processes and strategies in forms which might contribute to improved competitive performance. The first two papers critically assess concepts and measures of national competitiveness and review the performances of the economies of Britain, France, and the Federal German Republic. Then follow accounts of industrial competitiveness in three smaller economies (Belgium, Switzerland, and Sweden), which develop a series of methods and techniques for the analysis of industrial structures and indicate significant policy implications. The three concluding papers look at the competitiveness of British industry at the firm level, focusing on the strategic changes, the competitive process, and technical innovation. This book will be of interest to policy makers, business school teachers, and researchers in the area of strategy, industrial economics, organization behaviour, and innovation management.

Available in PDF, EPUB and Kindle. Book excerpt: 'This book is a most valuable contribution to the understanding of the complexity of European policies and their impact on individual businesses and industry as a whole. That focus makes this book unique. All in all, there are only a few books about the industrial policy of the European Union and none with such a focus.' - Karel van Miert, Universiteit Nyenrode, The Netherlands 'Contrary to standard works covering community industrial policy, this book is based on the experience of those involved in the actual formulation of policies. It documents the evolution of this policy towards a horizontal approach combining various instruments that need to be made consistent with each other. This book will be very valuable to scholars and policymakers alike.' - Alexis Jacquemin, European Commission and Université Catholique de Louvain, Belgium European policies increasingly affect the daily decisions of European firms. Better understanding of the motivation and reasoning behind policies that affect industry is therefore essential to those interested in or affected by industrial policy. Book International Competitiveness in Electronics

Download or read book International Competitiveness in Electronics written by Congress of the U.S., Washington, DC. Office of Technology Assessment and published by DIANE Publishing. This book was released on 1983 with total page 543 pages. Available in PDF, EPUB and Kindle. Book excerpt: This assessment continues the Office of Technology Assessment's (OTA) exploration of the meaning of industrial policy in the United States context, while also examining the industrial policies of several U.S. economic rivals. The major focus is on electronics, an area which virtually defines "high technology" of the 1980's. The assessment sets the characteristics of the technology itself alongside other forces that exert major influences over international competitiveness. Specific areas addressed include: electronics technology; structure, trade, and competitiveness in the international electronics industry; quality, reliability, and automation in manufacturing; role of financing in competitiveness and electronics; human resources (education, training, management); employment effects; national industrial policies; and U.S. trade policies and their effects. The report concludes by outlining five options for a U.S. industrial policy, drawing on electronics for examples of past and prospective impacts, as well as on OTA's previous studies of the steel and automotive industries. A detailed summary and introductory comments are included. Also included in appendices are case studies in the development and marketing of electronics products, a discussion of offshore manufacturing, and a glossary of terms used in the assessment. (JN)

Book Competition and Industrial Policy in the European Community

Download or read book Competition and Industrial Policy in the European Community written by Dennis Swann and published by Routledge. This book was released on 2018-01-09 with total page 189 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book, first published in 1983, is primarily concerned with the economic policies of the European Economic Community and the European Coal and Steel Community. It explains in detail how the common market was established and how it was maintained. Free competition cannot be created merely by removing customs duties and quotas: it is also necessary to attack the many non-tariff barriers which would otherwise impede free movement. Moreover, the Community sought to develop an industrial policy, notably in relation to the ECSC, to provide a stance towards declining industries suffering from Developing World competition.
