Download or read book The EU s Conceptualisation of the Rule of Law in its External Relations written by Lisa Louwerse and published by BRILL. This book was released on 2023-09-04 with total page 462 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the question of how the EU understands the ‘rule of law’ in its external relations, with a particular focus on development cooperation and enlargement. Although the EU’s commitment to the rule of law is strong, the relevant concept remains nebulous. On the basis of a detailed analysis of two key EU external policy areas, the main argument advanced is that the Union has adopted a mostly ‘institutional’ approach to the concept by focussing largely on judicial reform. By testing the relevant practice against the background of the constitutional traditions of the Member States and legal theory, the book attests to the significance of developing a comprehensive approach to the rule of law in EU external relations.

Download or read book Public Broadcasting and European Law written by Irini Katsirea and published by Kluwer Law International B.V.. This book was released on 2008-04-09 with total page 482 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important book examines the challenges posed to public service obligations by European Union media law and policy. An in-depth analysis of the extent to which six countries (France, Germany, Greece, Italy, the Netherlands, and the United Kingdom) regulate broadcasting for the public interest reveals a range of vulnerability to national political pressures or, alternatively, to the ideology of market sovereignty. The author examines the country of origin principle and the European quota rule of the Television without Frontiers Directive, revealing the influence of European law on the definition and enforcement of programme requirements, and shows how the case law of the European Court of Justice encourages deregulation at the national level without offering adequate safeguards at the supranational level in exchange. She asks the question whether the alleged ‘European audiovisual model’ actually persists—that is, whether broadcasting is still committed to protecting such values as cultural diversity, the safety of minors, the susceptibility of consumers to advertising, media pluralism, and the fight against racial and religious hatred. The book concludes with an evaluation of the impact of the EU state aid regime on the licence fee based financing of public broadcasting.

Download or read book REACH and the Environmental Regulation of Nanotechnology written by Nertila Kuraj and published by Routledge. This book was released on 2019-07-23 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: REACH and the Environmental Regulation of Nanotechnology presents a thorough and comprehensive legal analysis on the status of nanoscale chemicals under the EU’s REACH (Registration, Evaluation, Authorisation, and Restriction) regulation, asking whether it effectively safeguards human health and environmental protection. This book examines the European Commission’s claim that REACH offers the best possible framework for the risk management of nanomaterials. Through a detailed and meticulous analysis of the four phases of REACH, Kuraj assesses the capacity of the Regulation to protect human health and the environment against the potential harms associated with exposure to nanomaterials, and draws attention to the ways in which the specificities of nanoscale chemicals are (not) tackled by the current REACH framework. Overall, this book is an innovative and timely contribution to the ongoing debate on how to best address the unprecedented risks posed by the growing pursuit of nanotechnological innovation by the EU and global policy agenda. REACH and the Environmental Regulation of Nanotechnology will be of great interest to advanced students and scholars of environmental law and policy, environmental governance, science and technology studies, and environment and health.
