New governance models are shifting power away from states and toward the involvement of all stakeholders and the idea of shared responsibility. It's a move from command and control to push and pull. What's in this new approach for the environment? This book provides a detailed analysis of the example of integrated product policy (IPP) which aims to improve the environmental performance of products and services through their life-cycle. All products cause environmental degradation in some way, whether from their manufacturing, use or disposal. The life-cycle of a product is often long and complicated. It covers all the areas from the extraction of natural resources, through their design, manufacture, assembly, marketing, distribution, sale and use to their eventual disposal as waste. At the same time it also involves many different actors such as designers, manufacturers, marketers, retailers and consumers. IPP attempts to systematically stimulate each phase of this complicated chain to improve its environmental performance. With the involvement of so many different products and actors there cannot be one simple policy measure for everything. Instead, IPP employs a whole variety of tools – both voluntary and mandatory – which are used to achieve identified objectives. These include economic instruments, the phase-out of dangerous materials, voluntary agreements, eco-labelling and product design guidelines. IPP is still in relative infancy and can be seen as an ongoing process hugely dependent on effective governance measures to ensure its continued success. This book presents a plethora of perspectives from policy-makers, researchers and consultancies, representatives from business, environmental and consumer associations on how to effectively conceptualise, institutionalise and implement IPP. The book is divided into four parts. First, the approach to the governance of IPP is examined in relation to other approaches to sustainable production and consumption. Second, the widely differing approaches to environmental product policy in practice at national, supranational and global level are analysed. Third, the book explores the challenge of designing a coherent policy mix to support the integration of sustainable consumption and production patterns by sector and theme. Finally, the book concentrates on the key issue of how to involve stakeholders in IPP in order to encourage continuous innovations for sustainability throughout the value chain. Governance of Integrated Product Policy aims to fill a clear gap in work to date on sustainable production and consumption by providing researchers and practitioners from politics, business and civil society new insights into modern environmental governance in practice.

Specifically, how can it attain both legal integration and language diversity simultaneously, without the latter compromising the former? C.J.W. Baaij argues that the answer lies in the domain of translation. A uniform interpretation and application of EU law begins with the ways in which translators and jurist-linguists of the EU legislative bodies translate the original legislative draft texts into the various language versions. In the European Union, law and language are inherently connected. The EU pursues legal integration, i.e. the incremental harmonization and unification of its Member States' laws, for the purpose of reducing national regulatory differences between Member States. However, in its commitment to the diversity of European languages, its legislative institutions enact legislative instruments in 24 languages. Language Diversity and Legal Integration assesses these seemingly incompatible policy objectives and contemporary translation practices in the EU legislative procedure, and proposes an alternative, source-oriented approach that better serves EU policy objectives. Contrary to the orthodox view in academic literature and to the current policies of the EU, this book suggests that the English language version should serve as the original and only authentic legislative text. Translation into the other language versions should furthermore avoid prioritizing clarity and fluency over syntactic correspondence and employ neologisms for distinctly EU legal concepts. Ultimately, Baaij provides practical solutions to the conflict between the equality of all language versions, and the need for uniform interpretation and application of EU law.

Notwithstanding numerous regulatory interventions, curtailing the incidence of poor investment advice remains a challenge for regulators, particularly because these measures are taken in a 'fire-fighting' fashion without adequate consideration being given to the root causes of mis-selling. Against this backdrop, this book focuses on the sale of complex investment products to corporate retail investors by drawing upon the widespread mis-selling of interest rate hedging products (IRHP) in the UK and beyond. It brings to the fore the relatively understudied field concerning the different degrees of investor protection mechanisms applicable to individual retail investors – as opposed to corporate retail investors – by taking stock of past regulatory reforms and forthcoming regulatory initiatives as well as, more importantly, the conclusions reached by the judiciary in IRHP mis-selling claims. The conclusions are particularly interesting: corporate retail investors are in a vulnerable position when compared to individual retail investors. The former are exposed to a heightened risk of mis-selling, meaning that regulatory intervention should be targeted accordingly. The recommendations made as a result of these findings are further supported by insights emerging from behavioural law and economic theories. This book is aimed at researchers, lawyers and students with an interest in the financial regulation field who are keen to explore potential regulatory reforms to the investment services regime that address the root causes of mis-selling, and restore a level playing field amongst all retail investors.
