Download or read book Cooperation and Hegemony in US Latin American Relations written by Andrew R. Tillman and published by Springer. This book was released on 2016-03-29 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited volume revisits the idea of the Western Hemisphere. First articulated by Arthur P. Whitaker in 1954 but with origins in the earlier work of Herbert E. Bolton, it is the idea that "the peoples of this Hemisphere stand in a special relationship to one another which sets them apart from the rest of the word" (Whitaker, 1954). For most scholars of US-Latin American relations, this is a curious concept. They often conceptualize US-Latin American relations through the prism of realism and interventionism. While this volume does not deny that the United States has often acted as an imperial power in Latin America, it is unique in that it challenges scholars to re-think their preconceived notions of inter-American relations and explores the possibility of a common international society for the Americas, especially in the realm of international relations. Unlike most volumes on US-Latin American relations, the book develops its argument in an interdisciplinary manner, bringing together different approaches from disciplines including international relations, global and diplomatic history, human rights studies, and cultural and intellectual history.

This book was released on 2014-04-30 with total page 466 pages. Available in PDF, EPUB and Kindle. Book excerpt: Codifying Choice of Law Around the World chronicles, documents, and celebrates the extraordinary, massive codification of Private International Law (PrIL), or Conflict of Laws that has taken place in the last 50 years, from 1962-2012. During this period, the world has witnessed the adoption of nearly 200 PrIL codifications, EU Regulations, and international conventions---more than in all preceding years since the inception of PrIL. This book provides a horizontal comparison and discussion of these codifications and conventions, first by comparing the way they resolve tort and contract conflicts, and then by comparing the answers of these codifications to the fundamental philosophical and methodological dilemmas of PrIL. In the process, this book re-examines and dispels certain widely held assumptions about choice of law, and the art and science of codification in general. Written by Symeon C. Symeonides, a renowned PrIL and comparative law expert with extensive first-hand experience in drafting codifications and advising other drafters, Codifying Choice of Law Around the World will serve as an indispensable point of reference for any serious study or discussion of PrIL, and comparative law.

Download or read book Mestizo International Law written by Arnulf Becker Lorca and published by Cambridge University Press. This book was released on 2015-01-01 with total page 421 pages. Available in PDF, EPUB and Kindle. Book excerpt: The development of international law is conventionally understood as a history in which the main characters (states and international lawyers) and events (wars and peace conferences) are European. Arnulf Becker Lorca demonstrates how non-Western states and lawyers appropriated nineteenth-century classical thinking in order to defend new and better rules governing non-Western states' international relations. By internalizing the standard of civilization, for example, they argued for the abrogation of unequal treaties. These appropriations contributed to the globalization of international law. With the rise of modern legal thinking and a stronger international community governed by law, peripheral lawyers seized the opportunity and used the new discourse and institutions such as the League of Nations to dissolve the standard of civilization and codify non-intervention and self-determination. These stories suggest that the history of our contemporary international legal order is not purely European; instead they suggest a history of a mestizo international law.
Download or read book A Study of the Philosophy of International Law as Seen in Works of Latin American Writers written by H.B. Jacobini and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 166 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most unfortunate facts about the relationship of the United States with Latin America is that only in recent years has there been any appreciable amount of intellectual interchange with reference to law. This, of course, is an example of the relative lack of cultural exchange between these peoples. Only in very recent years has the North American interest in Latin America been in any sense general and active. While there are a few recent volumes which discuss various aspects of Latin American law in a fashion calculated to interest the North American lawyer and academician, the Latin American contributions to and attitudes toward international law are virtually unknown in the United States except in very restricted quarters. For this reason it was thought that a survey such as the one presented here would contribute not only to a better under standing of Latin American juristic thought as pertaining to international law, but also to a better comprehension of legal theory in general, and of Latin American culture as a whole. The phase of the philosophy of international law which, with reference to the regional application here studied, has been the major interest in this work, i.e., whether writers rely more on naturalism or positivism as the philosophical foundation of the law of nations, is, like the matter of Latin American law itself, a subject which has been neglected by North American scholars.
