Book Foreigners in European Prisons

Download or read book Foreigners in European Prisons written by A. M. van Kalmthout and published by . This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last few decades, the prison populations in European countries have grown and their profiles have changed. There are more than 100,000 foreign prisoners in European countries. Their numbers vary greatly from country to country, but the average percentage of foreigners in the total European prison population is over 20%. Why are foreigners over-represented in European prison populations? Who are they and on what grounds are they held in detention? Are foreign prisoners more vulnerable due to language difficulties, cultural differences, and their distance from relatives? Are they being socially excluded? Is their treatment and legal position different from other prisoners? And, how are national prison systems and other authorities addressing this issue? Funded by the European Commission, this extensive study - developed within the framework of the EU program "Social Exclusion" - offers an answer to the questions stated above. With this, a distinction is made between foreigners who are detained for committing a crime - or are suspected of one - and foreigners whose deprivation of liberty is based on migration law. Originally published as a two volume set in 2007, this comprehensive single volume reprint contains country reports of twenty-five EU Member States, as well as six reports of organizations which contributed to the research. The first chapter presents a comparative overview with conclusions and recommendations. At the end, a detailed bibliography will be given which includes relevant websites and legal documents.

Book Cardinal Giacomo Antonelli and Papal Politics in European Affairs

Download or read book Cardinal Giacomo Antonelli and Papal Politics in European Affairs written by Frank J. Coppa and published by SUNY Press. This book was released on 1990-01-01 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: Coppa provides the first full-length study of Giacomo Antonelli, friend and advisor to Pope Pius IX (Pio Nono) and his Secretary of State and chief minister from 1849 to 1876. Based on the documents of the secret Vatican Archives, and neglected family papers in the State Archive in Rome, the book gives an important reevaluation of this key diplomatic figure, separating the man from the myth and delving into his character and policies. The book examines both the personality and policies of the Cardinal, who was seen to be the Pope’s Richelieu and Mazarin combined. Confronting the polemical literature which has charged him with sexual misconduct and venality, the study examines his early formation and career, the inspiration for his European policies, his relationship to Pio Nono, and the part he played in the Counter-Risorgimento and the Papal reaction. By improving our understanding of Papal, Italian, and European developments during these crucial decades, this study provides new insights into Rome’s fortress mentality and its rejection of the main currents that were transforming western life— currents that influenced not only the Catholic Church but European society as a whole.

Book Secrecy National Security and the Vindication of Constitutional Law

Download or read book Secrecy National Security and the Vindication of Constitutional Law written by D. Cole and published by Edward Elgar Publishing. This book was released on 2013 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: ÔThis is an important collection of scholarly essays that will illuminate positive legal developments and normative constitutionalist concerns in the expanding arena of secret government decisions. This book is indispensable reading for those concerned with constitutionalism, the rule of law and democracy as they bear on the tensions between secrecy and disclosure in government responses to terrorism.Õ Ð Vicki C. Jackson, Harvard University Law School, US ÔThis book contains the broadest and deepest analysis of the legal and policy issues that relate to secrecy and national security on one hand, and the imperatives of a functioning democracy on the other. The broadest because it brings to bear materials from many countries, the deepest because it brilliantly explores a core problem of constitutional government.Õ Ð Norman Dorsen, New York University, US and President, American Civil Liberties Union, 1976Ð1991 Virtually every nation has had to confront tensions between the rule-of-law demands for transparency and accountability and the need for confidentiality with respect to terrorism and national security. This book provides a global and comparative overview of the implications of governmental secrecy in a variety of contexts. Expert contributors from around the world discuss the dilemmas posed by the necessity for Ð and evils of Ð secrecy, and assess constitutional mechanisms for checking the abuse of secrecy by national and international institutions in the field of counter-terrorism. In recent years, nations have relied on secret evidence to detain suspected terrorists and freeze their assets, have barred lawsuits alleging human rights violations by invoking Ôstate secretsÕ, and have implemented secret surveillance and targeted killing programs. The book begins by addressing the issue of secrecy at the institutional level, examining the role of courts and legislatures in regulating the use of secrecy claims by the executive branch of government. From there, the focus shifts to the three most vital areas of anti-terrorism law: preventive detention, criminal trials and administrative measures (notably, targeted economic sanctions). The contributors explore how assertions of secrecy and national security in each of these areas affect the functioning of the legal system and the application of procedural justice and fairness. Students, professors and researchers interested in constitutional law, international law, comparative law and issues of terrorism and security will find this an invaluable addition to the literature. Judges, lawyers and policymakers will also find much of use in this critical volume.
