Book excerpt: El intento de la Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales (LPRL) por instaurar una auténtica cultura preventiva en las empresas no ha logrado los resultados esperados. El fracaso de las buenas intenciones se ha vinculado en gran medida con un cumplimiento más formal y burocrático que eficaz y eficiente de las obligaciones impuestas por la norma, lo que ha provocado que la integración de la cuestión en la gestión empresarial haya sido muy débil o inexistente. Las reformas a la LPRL efectuadas por las Leyes 54/2003 y 29/2009, y las realizadas en 2006 y 2010 al Real Decreto 39/1997, de 17 de enero, por el que se aprueba el Reglamento de los Servicios de Prevención (RSP), su principal norma de desarrollo, aspiran a solventar el problema rediseñando los mandatos referentes a la implantación y desarrollo de un sistema de prevención integrado en el sistema general de gestión de la empresa. El cauce previsto para lograr dicha integración y para diseñar la política preventiva de la entidad no es otro que el plan de prevención de riesgos laborales, elevado a rango legal en 2003 (hasta entonces únicamente se contemplaba en el RSP) y situado en plano de superioridad respecto a la evaluación de riesgos y la planificación de actividades preventivas, que quedan convertidos en instrumentos al servicio de aquél. Este estudio pretende ofrecer una descripción de dicho plan, centrando la atención en algunos aspectos especialmente importantes de su contenido (la organización de la prevención y la representación de los trabajadores en la materia, señaladamente), así como en el mecanismo previsto en la ley para evaluar su eficacia y avanzar en un proceso constante de mejora: las auditorías externas reglamentariamente establecidas.
