This book, unlike most other books on the subject, contrasts two different colonial administrations – first the Chinese Qing Empire, then, from 1895, the Japanese. It shows how, under the Chinese legal system, the Qing employed the Chinese legal system to manage the relationship between the increasing numbers of Han Chinese settlers and the indigenous peoples, and how, although the Qing regime refrained from taking actions to transform aboriginal land tenure, nevertheless Chinese settlers were able to manipulate aboriginal land tenure to their advantage. It goes on to examine the very different approach of the Japanese colonial administration, which following the Meiji Restoration of 1868 had begun to adopt a Western legal framework, demonstrating how this was intentionally much more intrusive, and how the Japanese modernized legal framework significantly disrupted aboriginal land tenure. Based on extensive original research, the book provides important insights into colonisation, different legal traditions and the impact of colonial settlement on indigenous peoples.

Book excerpt: Modern Korean nationalism has been shaped by the turbulent historical forces that shook and transformed the peninsula during the twentieth century, including foreign occupation, civil war, and division. This book examines the emergence of the nation as the hegemonic form of collective identity after the March First Movement of 1919, widely seen as one of the major turning points of modern Korean history. The analysis focuses on Yi Gwangsu (1892–1950), a pioneering novelist, newspaper editor, and leader of the nationalist movement, who was directly involved in many aspects of its emergence during the Japanese occupation period. Yi Gwangsu was one of the few intellectuals who not only wrote for almost the entirety of the colonial period but who also was centrally involved in many institutions related to the production of identity. By focusing on Yi Gwangsu the book provides a different kind of historical narrative linking the various fragments of the nation, puts forward a new understanding of the March First Movement and its role in the emergence of the nation, and demonstrates how central to the emergence of the nation were the development of the print industry, the rise of a modern readership, and the emergence of a capitalist market for print. This book shows how the March First Movement catalyzed the confluence of these factors, enabling the nation to emerge as the dominant form of collective identity.

Book excerpt: Since the 1990s, questions of Japanese wartime conduct, apologies for aggression, and compensation to former victims of the country’s imperial policies, have been brought to the fore of national and regional politics. The state is undoubtedly the most important actor in the process of memory production and along with conservative legislators and the grass-root revisionist movement there has been a consistent trend towards denying or undermining the existing acknowledgments of responsibility for Japan’s wartime past. However, to fully comprehend war memory in Japan, due attention must be paid to competing discourses that demand an alternative view, and only then can the complexity of Japanese war memory and attitudes towards the legacies of the Asia-Pacific war be understood. The Politics of War Memory in Japan examines the involvement of five civil society actors in the struggle over remembering and addressing the wartime past in Japan today. In studying progressive war memory activists, it quickly becomes clear that the apologia by conservative politicians cannot be treated as representative of the opinion of the majority of the Japanese public. Indeed, this book seeks to remedy the disparity between studies devoted to the official level of addressing the ‘history issue’ and the grass-root historical revisionist movement on the one side, and progressive activism on the other. Furthermore, it contributes to scholarly debates on the state of civil society in Japan, challenging the characterisation of Japanese civil society as a depoliticised space by demonstrating a more contentious side of civil society activism. Drawing important new empirical research, this book will be of huge interest to students and scholars of Japanese civil society, Japanese politics, Japanese history and memory in Japan.
