The book highlights the historical context which gave rise to the need for a programme of normalisation within the Belfast Agreement with respect to these areas and assesses the extent to which that programme of normalisation has been successfully implemented. By evaluating the implementation of the Belfast Agreement, the book demonstrates the difficulties that transitional or post-conflict states face in attempting to wind back extraordinary counter-terrorism policies after periods of violence have been brought to an end. Book excerpt: Preventive Detention and the Democratic State tracks the transformation of preventive detention from an emergency measure into an ordinary law enforcement tool in the democratic world. Historically, democracies used preventive detention only in the extraordinary circumstance in which the criminal justice system was impotent. They preferred criminal prosecution and its strict due process requirements to detaining people for a crime they may never commit. This book shows that major democracies have begun using detention as an insurance policy against dangerous people. In the process, they have embarked on a slippery slope that allows them to use preventive detention to bypass the criminal justice system. Already, detention has established a separate, inferior legal system for certain suspected criminals. Comparing preventive detention in India, England and the United States, the book brings to light its potentially dire consequences for the rule of law, due process rights and democratic principles based on the very real experiences of these countries.

Although street demonstrations began in the summer of 1968 and lasted a year, activism to advance Ulster’s catholic community originated in the late 1950s. During this period, Paisley crusaded against Protestant apostasy and the liberalization of the Unionist government, and asserted a Calvinist response for protestants. Paisley formed a political and theological association with North Americans who professed militant fundamentalism and fought the integration of American society. Between 1965 and 1968, Paisley made three visits to the United States and Canada. During these extensive speaking tours, he witnessed the consequence to a successful campaign. The relationship, religiosity and first-hand knowledge of current events helped to shape Paisley’s counter-demonstrations in Northern Ireland, and create an atmosphere for sectarian strife and the “Troubles.”

Book excerpt: The peace, order and good government (POGG) clause is found in the constitutions of almost all Commonwealth countries. Since its introduction, the clause has played a significant role in colonial and post-colonial constitutionalism in Commonwealth jurisdictions. This book is the first full length analysis of the various dimensions of the peace, order and good government clause. It argues that the origins of the POGG clause mark it out as an anachronistic feature of British constitutionalism when seen against a modern setting of human rights, liberty and democratisation. The book traces the history, politics and applications of the clause through the colonial period in Commonwealth territories to date. It provides critical evaluation of the POGG clause in a cross-continental enquiry, examining statutory, political and constitutional deployment in Australia, Canada, India, Nigeria, South Africa and the United Kingdom. The evaluation demonstrates that the POGG clause has relevance in a number of significant aspects of legal and socio-political ordering across the Commonwealth featuring prominently in the federalism question, emergency powers and the review of administrative powers. It maintains that while the clause is not entirely devoid of positive value, the POGG clause has been used not only to further the objects of colonialism, but also authoritarianism and apartheid. This book calls for a rethink of the prevailing subjective approach to the interpretation of the clause. Book excerpt: British forces conducted operations short of war in Northern Ireland for twenty-five years, yet they were unable to defeat the Provisional Irish Republican Army (PIRA). In this heretofore unpublished dissertation from 1994, McFate identifies how certain cultural, legal, and political factors contributed to the longevity of violence in Northern Ireland. Viewing counterinsurgency as a self-reproducing cultural system with its own complex logic, McFate argues that limitations on violence prescribed by the counterinsurgency principle of minimum force paradoxically resulted in a very high degree of sustainability of conflict. Certain other factors—such as emergency security legislation, reverence of military competence, and geo-strategic compression of violence within a cordon sanitaire—enabled normalization and reproduction of the conflict. In opposition to this order, the 1981 Republican hungerstrikes used the silence of the body to incriminate the state, 'embodying' a resistance to the war system of counterinsurgency.
