Building on a variety of methodological and theoretical trends—cultural history, subaltern studies, new political history, and others—the contributors share the conviction that law and legal phenomena are crucial elements in the formation and functioning of modern Latin American societies and, as such, need to be brought to the forefront of scholarly debates about the region’s past and present. While disassociating law from a strictly legalist approach, the volume showcases a number of highly original studies on topics such as the role of law in processes of state formation and social and political conflict, the resonance between legal and cultural phenomena, and the contested nature of law-enforcing discourses and practices. Book excerpt: Female Citizens, Patriarchs, and the Law in Venezuela examines the effects that liberalism had on gender relations in the process of state formation in Caracas from the late eighteenth to the nineteenth century. The 1811 Venezuelan constitution granted everyone in the abstract, including women, the right to be citizens and equals, but at the same time permitted the continued use of older Spanish civil laws that accorded women inferior status and granted greater authority to male heads of households. Invoking citizenship for their own protection and that of their loved ones, some women went to court to claim the same civil liberties and protections granted to male citizens. In the late eighteenth century, colonial courts dispensed some protection to women in their conflicts with men; a century later, however, patriarchal prerogatives were reaffirmed in court sentences. Discouraging as this setback was, the actions of the women who had fought these legal battles raised an awareness of the discrepancies between the law and women?s daily lives, laying the groundwork for Venezuelan women?s organizations in the twentieth century. Drawing on a wealth of primary sources, historian Arlene D�az shows how the struggle for political power in the modern state reinforced and reproduced patriarchal authority. She also reveals how Venezuelan women from different classes, in public and private, coped strategically with their paradoxical status as equal citizens who nonetheless lacked power because of their gender. Shedding light on a fundamental but little examined dimension of modern nation building, Female Citizens, Patriarchs, and the Law in Venezuela gives voice to historic Venezuelan women while offering a detailed look at a society making the awkward transition from the colonial world to a modern one.

Book excerpt: Offering a corrective to previous views of Spanish-American independence, this book shows how political culture in Peru was dramatically transformed in this period of transition and how the popular classes as well as elites played crucial roles in this process. Honor, underpinning the legitimacy of Spanish rule and a social hierarchy based on race and class during the colonial era, came to be an important source of resistance by ordinary citizens to repressive action by republican authorities fearful of disorder. Claiming the protection of their civil liberties as guaranteed by the constitution, these &"honorable&" citizens cited their hard work and respectable conduct in justification of their rights, in this way contributing to the shaping of republican discourse. Prominent politicians from Arequipa, familiar with these arguments made in courtrooms where they served as jurists, promoted at the national level a form of liberalism that emphasized not only discipline but also individual liberties and praise for the honest working man. But the protection of men's public reputations and their patriarchal authority, the author argues, came at the expense of women, who suffered further oppression from increasing public scrutiny of their sexual behavior through the definition of female virtue as private morality, which also justified their exclusion from politics. The advent of political liberalism was thus not associated with greater freedom, social or political, for women.

Book excerpt: Before 1865, slavery and freedom coexisted tenuously in America in an environment that made it possible not only for enslaved women to become free but also for emancipated women to suddenly lose their independence. Wilma King now examines a wide-ranging body of literature to show that, even in the face of economic deprivation and draconian legislation, many free black women were able to maintain some form of autonomy and lead meaningful lives. The Essence of Liberty blends social, political, and economic history to analyze black women's experience in both the North and the South, from the colonial period through emancipation. Focusing on class and familial relationships, King examines the myriad sources of freedom for black women to show the many factors that, along with time spent in slavery before emancipation, shaped the meaning of freedom. Her book also raises questions about whether free women were bound to or liberated from gender conventions of their day. Drawing on a wealth of untapped primary sources--not only legal documents and newspapers but also the diaries, letters, and autobiographical writings of free women--King opens a new window on the world of black women. She examines how they became free, educated themselves, found jobs, maintained self-esteem, and developed social consciousness--even participating in the abolitionist movement. She considers the stance of southern free women toward their enslaved contemporaries and the interactions between previously free and newly freed women after slavery ended. She also looks closely at women's spirituality, disclosing the dilemma some women faced when they took a stand against men--even black men--in order to follow their spiritual callings. Throughout this engaging history, King underscores the pernicious constraints that racism placed on the lives of free blacks in spite of the fact that they were not enslaved. The Essence of Liberty shows the importance of studying these women on their own terms, revealing that the essence of freedom is more complex than the mere absence of shackles.
