In the backdrop of the gravity of groundwater crisis that threatens to engulf the country, the book examines the correlation between the imperfections in the law and water crisis and advocates a reform agenda to overhaul the legal framework. It accomplishes this objective by examining how some of the States and Union Territories regulate and manage groundwater through the legal instrumentality against the backdrop of the two conflicting paradigms: the “elitist” and the “egalitarian.” The book’s fundamental premise is that despite being an extraordinarily critical resource that supports India’s burgeoning population’s ever-increasing water demands, groundwater is abused and mismanaged. The key argument that it posits is that the elitist paradigm must give way to an egalitarian one where groundwater is treated as a common property resource. To place this message in perspective, the book’s introduction explains the dichotomy between the two paradigms in the context of groundwater. This sets the stage, after which the book is divided thematically into three parts. The first part deals with some of the general groundwater management concerns brought to the fore by the operation of the elitist paradigm. Since water is constitutionally a State subject, the second part analyses the groundwater legislations of different States and Union Territories set against their unique circumstances. As these laws do not dismantle the elitist paradigm that interlocks groundwater rights to land rights, the next part articulates the legal reform agenda where a case is made to re-engineer groundwater laws to reflect a more sustainable basis. Book excerpt: Honorable Mention, 2018 Global Division Book Award presented by the Global Division of the Society for the Study of Social Problems Historically, the Indian state has not offered welfare and social rights to all of its citizens, yet a remarkable characteristic of its polity has been the ability of citizens to dissent in a democratic way. In Undervalued Dissent, Manjusha Nair argues that this democratic space has been vanishing slowly. Based on extensive fieldwork in Chhattisgarh, a regional state in central India, this book examines two different informal workers' movements. Informal workers are not part of organized labor unions and make up eighty-five percent of the Indian workforce. The first movement started in 1977 and was a success, while the other movement began in 1989 and still continues today, without success. The workers in both movements had similar backgrounds, skills, demands, and strategies. Nair maintains that the first movement succeeded because the workers contended within a labor regime that allowed space for democratic dissent, and the second movement failed because they contested within a widely altered labor regime following neoliberal reforms, where these spaces of democratic dissent were preempted. The key difference between the two regimes, Nair suggests, is not in the withdrawal of a prolabor state from its protective and regulatory role, as has been argued by many, but rather in the rise of a new kind of state that became functionally decentralized, economically predatory, and politically communalized. These changes, Nair concludes, successfully de-democratized labor politics in India.

Apart from rapes and killings, hundreds of “surrendered” Maoist sympathizers were conscripted as auxiliaries. The conflict continues to this day, taking a toll on the lives of civilians, security forces and Maoist cadres. In 2007, Sundar and others took the Indian government to the Supreme Court over the human rights violations arising out of the conflict. In a landmark judgment in 2011 the court banned state support for vigilantism. The Burning Forest describes this brutal war in the heart of India, and what it tells us about the courts, media and politics of the country. The result is a fascinating critical account of Indian democracy.

Another limited and outmoded approach is an exaggerated focus on Western interventions, especially military ones, as a "solution" to problems in poor or conflict-prone areas. "Human Security" was introduced as a construct by the UNDP in 1994. The inherent combination of law-enforcement and people-centred humanitarianism has strived to provide an umbrella to both protect people from threats while empowering them to control their destinies. But with accelerating economic globalization and information flows there is a need to revisit the concept. A new paradigm of Sustainable Human Security is required. This book argues that proponents of a human security approach should welcome efforts to remove the barriers between enterprise, corporations, aid and development agencies, government agencies, citizen groups and the UN; and work towards multi-stakeholder approaches and solutions for vulnerable populations. Such an approach is clearly vital in responding to the imperatives of concerted action on issues such as climate change, HIV, terrorism, organised crime and poverty. The agenda may have changed, but it remains true that almost all human tragedies are avoidable. This book examines a number of global problems through the lens of human security and the needs of the individual: global governance; health; the environment and the exploitation of natural resources; peace and reconciliation; the responsibility to protect; and economic development and prosperity. In the latter case, the role of business in the human security pantheon is promulgated.
