The United States District Court for the Eastern District of Michigan, the federal trial court based in Detroit with jurisdiction over the eastern half of Michigan, was created in 1837 and operated as recently as 1923 with a single trial judge. Yet by 2010, the court had fifteen district judges, a dozen senior U.S. district judges and U.S. magistrate judges, and conducts court year-round in five federal buildings throughout the eastern half of Michigan (in Detroit, Bay City, Flint, Port Huron, and Ann Arbor). In The United States District Court for the Eastern District of Michigan: People, Law, and Politics, author David Gardner Chardavoyne details not only the growth of the court but the stories of its judges and others who have served the court, litigants who brought their conflicting interests to the court for resolution, and the people of the district who have been affected by the court. In chronological order, Chardavoyne charts the history of the court, its judges, and its major cases in five parts: The Wilkins Years, 1837 to 1870; The Industrial Revolution and the Gilded Age, 1870 to 1900; Decades of Tumult, 1900 to 1945; The Era of Grand Expectations, 1946 to 1976; and A Major Metropolitan Court, 1977 to 2010. Along the way, Chardavoyne highlights many issues of national concern faced by the court, including cases dealing with fugitive slave laws, espionage and treason, civil rights, and freedom of speech. Chardavoyne also examines how conflicting interests—political, local, and personal—have influenced the resolution of a myriad of issues not directly related to the court’s cases, such as who becomes a federal judge, how many judges the court should have, in which cities and in which buildings the judges hold court, what kinds of cases the judges can and cannot hear, and the geographical boundaries of the district and of divisions within the district. This volume includes helpful appendixes that list the Eastern District of Michigan Court’s Chief Judges, Clerks, Magistrates and Magistrate Judges, and United States Marshals; along with the succession of judges, and a list of District and Circuit Court Case Filings, 1837–2010. Posner offers in this new book a unique and, to orthodox legal thinkers, a startling perspective on how judges and justices decide cases. When conventional legal materials enable judges to ascertain the true facts of a case and apply clear pre-existing legal rules to them, Posner argues, they do so straightforwardly; that is the domain of legalist reasoning. However, in non-routine cases, the conventional materials run out and judges are on their own, navigating uncharted seas with equipment consisting of experience, emotions, and often unconscious beliefs. In doing so, they take on a legislative role, though one that is confined by internal and external constraints, such as professional ethics, opinions of respected colleagues, and limitations imposed by other branches of government on freewheeling judicial discretion. Occasional legislators, judges are motivated by political considerations in a broad and sometimes a narrow sense of that term. In that open area, most American judges are legal pragmatists. Legal pragmatism is forward-looking and policy-based. It focuses on the consequences of a decision in both the short and the long term, rather than on its antecedent logic. Legal pragmatism so understood is really just a form of ordinary practical reasoning, rather than some special kind of legal reasoning. Supreme Court justices are uniquely free from the constraints on ordinary judges and uniquely tempted to engage in legislative forms of adjudication. More than any other court, the Supreme Court is best understood as a political court.

Book excerpt: In colonial America, the system of "warning out" was distinctive to New England, a way for a community to regulate those to whom it would extend welfare. Robert Love's Warnings animates this nearly forgotten aspect of colonial life, richly detailing the moral and legal basis of the practice and the religious and humanistic vision of those who enforced it. Historians Cornelia H. Dayton and Sharon V. Salinger follow one otherwise obscure town clerk, Robert Love, as he walked through Boston's streets to tell sojourners, "in His Majesty's Name," that they were warned to depart the town in fourteen days. This declaration meant not that newcomers literally had to leave, but that they could not claim legal settlement or rely on town poor relief. Warned youths and adults could reside, work, marry, or buy a house in the city. If they became needy, their relief was paid for by the province treasurer. Warning thus functioned as a registration system, encouraging the flow of labor and protecting town coffers. Between 1765 and 1774, Robert Love warned four thousand itinerants, including youthful migrant workers, demobilized British soldiers, recently exiled Acadians, and women following the redcoats who occupied Boston in 1768. Appointed warner at age sixty-eight owing to his unusual capacity for remembering faces, Love kept meticulous records of the sojourners he spoke to, including where they lodged and whether they were lame, ragged, drunk, impudent, homeless, or begging. Through these documents, Dayton and Salinger reconstruct the biographies of travelers, exploring why so many people were on the move throughout the British Atlantic and why they came to Boston. With a fresh interpretation of the role that warning played in Boston's civic structure and street life, Robert Love's Warnings reveals the complex legal, social, and political landscape of New England in the decade before the Revolution.

Nelson's magisterial four-volume The Common Law in Colonial America traces how the many legal orders of Britain's thirteen North American colonies gradually evolved into one American system. Initially established on divergent political, economic, and religious grounds, the various colonial systems slowly converged until it became possible by the 1770s to imagine that all thirteen participated in a common American legal order, which diverged in its details but differed far more substantially from English common law. This fourth and final volume begins where volume three ended. It focuses on the laws of the thirteen colonies in the mid-eighteenth century and on constitutional events leading up to the American Revolution. Nelson first examines procedural and substantive law and looks at important shifts in the law to show how the mid-eighteenth- century colonial legal system in large part functioned effectively in the interests both of Great Britain and of its thirteen colonies. Nelson then turns to constitutional events leading to the Revolution. Here he shows how lawyers deployed ideological arguments not for their own sake, but in order to protect colonial institutional structures and the socio-economic interests of their clients. As lawyers deployed the arguments, they developed them into a constitutional theory that gave primacy to common-law constitutional rights and local self-government. In the process, the lawyers became leaders of the revolutionary movement and a dominant political force in the new United States.
