Book African Yearbook of International Law Annuaire Africain de Droit International

This book was released on 1995-01-01 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: Founded in 1993, the African Yearbook, now published under the auspices of the African Foundation for International Law, is the only scholarly publication devoted exclusively to the study, development, dissemination and wider appreciation of international law in Africa as a whole. Through the scholarly analysis of international legal issues of particular relevance to the African continent, it also contributes to the acceptance of, and respect for the rule of law in intra-African relations, and for the principles of international law in general. Its uniqueness however goes beyond this, for through its special themes and general articles, it has succeeded over the years to serve as an intellectual forum where the development of international law is viewed as being integral to Africa's own development. Through the study and analysis of emerging legal issues of particular relevance to Africa, such as the creation of viable continental institutions capable of promoting unity and security for the peoples of the continent, the effective protection of human rights, the need for accountability for mass killings and massive violations of the rule of law, the promotion of a rule-based democratic culture, the role of African countries in a globalizing world economy and in international trade relations, the Yearbook strives to be responsive to the intellectual needs of African countries in the area of international law, andtothe continuing struggle for creating an environment conducive to the rule of law throughout the continent. The Yearbook also provides ready access to the basic documents of African international organizations by regularly publishing the resolutions and decisions ofregional and sub-regional organizations as well as the conventions, protocols and declarations adopted by pan-african agencies. Book Fairness and the Goals of International Criminal Trials

Download or read book Fairness and the Goals of International Criminal Trials written by Caleb H Wheeler and published by Taylor & Francis. This book was released on 2023-04-28 with total page 170 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents a ground-breaking, interdisciplinary study into the various goals assigned to international criminal trials. It starts from the proposition that no hierarchy exists amongst the different goals meaning that trials should strive to achieve all of them in equal measure. This is made difficult by the fact that not all of these goals are compatible and the fulfilment of one may lead to others going unmet. Therefore, a balance must be found if the goals of trial are to be achieved at all. The book posits that fairness should serve as the guiding principle when weighing the different trial goals against one another. It is argued that without fairness international and internationalised criminal courts and tribunals lack legitimacy and without legitimacy they lack effectiveness. The book concludes that international criminal trials must adopt procedures that emphasise fairness to all of the parties and trial participants if they wish to accomplish any of the goals set for them. Each chapter is devoted to identifying and explaining a different trial goal, providing analysis of how that particular goal functions in conjunction with the other goals, and discussing the ways in which a fairness-oriented trial model will help achieve those goals. The book provides a dynamic understanding of the different trial goals and the importance of fairness in the trial process by drawing on research from a variety of different legal disciplines while also incorporating scholarship rooted in criminology, political theory, international relations, and psychology. The book will be essential reading for researchers, academics and professionals working in the areas of International Criminal Law, Public International Law and Transitional Justice.

Book Peacebuilding in the African Union

Download or read book Peacebuilding in the African Union written by Abou Jeng and published by Cambridge University Press. This book was released on 2012-08-02 with total page 351 pages. Available in PDF, EPUB and Kindle. Book excerpt: Particularly in the context of internal conflicts, international law is frequently unable to create and sustain frameworks for peace in Africa. In Peacebuilding in the African Union, Abou Jeng explores the factors which have prevented such steps forward in the interaction between the international legal order and postcolonial Africa. In the first work of its kind, Jeng considers whether these limitations necessitate recasting the existing conceptual structure and whether the Constitutive Act of the African Union provides exactly this opportunity through its integrated peace and security framework. Through the case studies of Burundi and Somalia, Jeng examines the structures and philosophy of the African Union and assesses the capacity of its practices in peacemaking. In so doing, this book will be of great practical value to scholars and legal practitioners alike.
