In countries with high-value natural resources – including oil, gas, diamonds, other minerals, and timber –the stakes are unusually high and peacebuilding is especially challenging. Resource-rich post-conflict countries face both unique problems and opportunities. They enter peacebuilding with an advantage that distinguishes them from other war-torn societies: access to natural resources that can yield substantial revenues for alleviating poverty, compensating victims, creating jobs, and rebuilding the country and the economy. Evidence shows, however, that this opportunity is often wasted. Resource-rich countries do not have a better record in sustaining peace. In fact, resource-related conflicts are more likely to relapse. Focusing on the relationship between high-value natural resources and peacebuilding in post-conflict settings, this book identifies opportunities and strategies for converting resource revenues to a peaceful future. Its thirty chapters draw on the experiences of forty-one researchers and practitioners – as well as the broader literature – and cover a range of key issues, including resource extraction, revenue sharing and allocation, and institution building. Many of the countries that are members of the International Conference on the Great Lakes Region (ICGLR) which are: Burundi, Angola, Central African Republic, Democratic Republic of the Congo, Republic of the Congo, Kenya, Uganda, Rwanda, Sudan, South Sudan, Tanzania, and Zambia, have experienced political violence and bloodshed at one time or another. While a few states have been advancing electoral democracy, environmental protection and peaceful state building, the overall intensity of violence in the region has led to civil wars, invasion, genocide, dictatorships, political instability, and underdevelopment. Efforts to establish sustainable peace, meaningful socio-economic development and participatory democracy have not been quite successful. Using various methodologies and paradigms, this book interrogates the complexity of the causes of these conflicts; and examines their impact and implications for socio-economic development of the region. The non-consensual actions related to these conflicts and imperatives of power struggles supported by the agents of savage capitalism have paralysed efforts toward progress. The book therefore recommends new policy frameworks within regionalist lenses and neo-realist politics to bring about sustainable peace in the region.

The problem of corruption has become increasingly important in war to peace transitions, eroding confidence in new democratic institutions, undermining economic development, diverting scarce public resources, and reducing the delivery of vital social services. Conflict-affected countries offer an ideal environment for pervasive corruption. Their weak administrative institutions and fragile legal and judicial systems mean that they lack the capacity to effectively investigate and punish corrupt behaviour. In addition, the sudden inflow of donor aid into post-conflict countries and the desire of peacebuilding actors (including the UN, the international financial institutions, aid agencies, and non-governmental organisations) to disburse these funds quickly, create incentives and opportunities for corruption. While corruption imposes costs and compromises on peacebuilding efforts, opportunities for exploiting public office can also be used to entice armed groups into signing peace agreements, thus stabilising post-war environments. This book explores the different functions of corruption both conceptually and through the lens of a wide range of case studies. It also examines the impact of key anti-corruption policies on peacebuilding environments. The dynamics that shape the relationship between corruption and the political and economic developments in post-conflict countries are complex. This analysis highlights that fighting corruption is only one of several important peacebuilding objectives, and that due consideration must be given to the specific social and political context in considering how a sustainable peace can be achieved. Key international stakeholders—from activists to politicians, humanitarian agencies to financial institutions—characterize disparate sites as “weak,” “fragile,” or “failed” states and, as a result, prescribe peacebuilding techniques that paradoxically disable effective management of post-conflict spaces while perpetuating neoliberal political and economic conditions. Treating all efforts to represent post-conflict environments as problematic, the goal becomes understanding the underlying connection between post-conflict conditions and the actions and interventions of peacebuilding technocracies.

Environmental protection is fundamental for the establishment of sustainable peace. Applying traditional legal approaches to protection raises particular challenges during the transition from conflict to peace. In the jus post bellum context, protection of the environment and natural resources needs to be considered in tandem with a broad range of simultaneously applicable normative frameworks, such as human rights, transitional justice, arms control/disarmament, UN law and practice, development, and domestic law. While certain multilateral environment agreements, such as the Convention Concerning the Protection of the World Cultural and Natural Heritage protect the environment; international humanitarian law and international criminal law continue to treat environmental protection largely from an anthropocentric perspective. This book is the first targeted work in the legal literature that investigates environmental challenges in the aftermath of conflict. Addressing these challenges, it brings together academics, policy-makers, and practitioners from different disciplines to clarify policies and practices of environmental protection and key normative frameworks.
