Excerpt: ...of any county in excess of the said amount shall be null and void, and no suits shall be prosecuted in this State for the collection of the same; provided, that the county commissioners of each county shall levy a tax not to exceed five mills, nor less than three and one-quarter mills, on the dollar on the real and personal property of the county for county school purposes; provided further, that the county commissioners of any county may levy an additional tax not to exceed four mills on the dollar each year to pay all outstanding indebtedness and interest thereon; provided, that nothing in this act shall be so construed as to prohibit any county wishing to erect a court house or jail from levying the amount of special taxes now allowed by law for that purpose; provided further, this act shall not apply to counties working roads under special laws." "Sec. 4. All laws and parts of laws in conflict with this act are hereby repealed." In regard to the State levy of five and onequarter mills it is contended that under the first section of the act above quoted the rate limit for State taxes to pay the appropriations for the current expenses of the State for 1897 is fixed at three and one-half mills, which, with the constitutional school tax of one mill, makes a total rate of four and onehalf mills, and that the board of health rate of one-quarter mill and the pension rate of half mill should have been included in the three and one-half mill rate for general revenue. For the State it is contended that the board of health rate is authorized by a special law (Section 784 Rev. Stats.) and that the pension rate is also authorized by a special law, being Chapter 4520. passed at the same session of the legislature when Chap. 4515...

Our attention has been called by the respective counsel to a number of authorities bearing upon 91656 grounds and we have had the benefit not only of carefully prepared briefs relating thereto but of elaborate oral arguments as well. The second assignment of error is, that the court frred in permitting the witness Eastman to give the meaning of the following telegram received by him of the 23rd day of December, 1905, directed to the schooner Doris: "Havana Done 23, Schooner Doris. Offer you 650 Tampa Nipe. Answer. Pratt." The plaintiff had introduced testimony, by the witness Eastman, that he was captain of the schooner Doris; that the schooner was engaged in the lumber trade between the coast of Cuba and the Gulf Ports, and that Pratt was in the ship brokerage business at Havana, and bT0l'er for Eastman; that witness had received the above telegram, and was familiar with the business of making charter parties, and that said telegram had a well understood meaning between people engaged in the business of making charter parties at that time. The plaintiffs then propounded to Eastman the following question: "State what that meaning was." Defendant objected to the interpretation of the witness in regard to the meaning Of the telegram. The court overruled the objection and the witness answered: "That meaning is that he would Pay me $6.50 per thousand for a cargo of lumber from Tampa to Nipe Bay." The witness did not give his construction or interPretation of the message. He interpreted the writing "1 ElCcordance with the recognized meaning of the words '5 11Sed in the trade or business out of which the trans ac_tlOn arose.
