Book excerpt: Studies in industrial relations have concentrated on national differences or variation among industries, with regions assumed to be the result of industrial structure. Traditional treatments of Canadian industrial relations have either ignored regional differences or contrasted Quebec with the other nine provinces. Beyond the National Divide contains separate chapters on eight provinces, plus an introduction to the topic and a conclusion that explains the results in theoretical terms.By examining the economic, political, and social forces that influence industrial relations, authors found that two groups of provinces exist: those with "confirmed systems" and those with "dependent systems." Confirmed systems are found in Quebec, Ontario, Manitoba, and British Columbia. In these provinces the institutions of collective bargaining and unionism are well established and respected by other stakeholders and labour organizations are important actors in the political and economic life of the province. Dependent industrial relations systems exist in Newfoundland, Nova Scotia, Saskatchewan, and Alberta. In these provinces the institutions of industrial relations lack the strength to resist incursions from hostile governments or employers and the labour movement is a minor actor in the province's economic and political life. Book excerpt: This book examines the everyday judicial experience in four multicultural jurisdictions as a means of exploring the relationship between legal systems and cultural identities. Increasing social heterogeneity has deeply affected legal systems as courts and parliaments must now deal with a growing rate of cases concerning cultural pluralism. Headline-grabbing disputes usually concern challenges to fundamental rights and principles which may be put at risk by some religious or cultural practices. These are difficult issues questioning the compatibility between some cultural and religious practices and constitutional values. However, much of the interaction between law and cultural pluralism also concerns daily life activities, which do not necessarily challenge fundamental rights. This book deals with food, clothing and days of rest: three expressions of both human needs and identity which are based on ethnic origin, tradition, culture, religion or, simply, taste. The volume looks at the intersection between these choices and constitutional rights such as religious liberty or freedom of expression. It aims to understand how the state legal system deals with them and when non-mainstreaming behaviours are accommodated. Four legal systems are taken into consideration – the United States of America, Canada, France and Italy – exploring similarities and differences in facing cultural diversity around these quotidian issues. The book pays particular attention to the places where diversity is most apparent and also considers the choices that are not based on religious precepts, but rather on “personal philosophy”. The book will be of interest to researchers, academics and policy-makers working in the areas of constitutional law, law and cultural diversity, human rights, minority rights and discrimination law.

However, the most common qualification for a strike is that the action must first be approved by ballot. These types of requirements are often said to be necessary to protect the democratic rights of the workers - the so-called democratic imperative. But is that truly their aim? This book draws on detailed empirical study of the Australian legislative provisions for pre-strike ballots; a comparative analysis of law and practice in a range of countries including Canada, South Africa, the United States, and the United Kingdom; and the approaches of the supervisory bodies of the International Labour Organisation to evaluate the true purpose and effect of the ballot requirement. While in some cases the ballot requirement provided additional bargaining leverage for unions, overall, the study showed that the principle purpose of ballot requirements is to curtail strikes rather than vindicate the democratic imperative it claims to support. Exploring collective bargaining and union democracy, this is an essential title for those involved in or studying labour law. This book also demonstrates the fundamental shortcomings of ballot regimes, and provides and accessible exploration of the operation of said regimes, which makes this a helpful tool for unionists to understand their rights as workers. It also considers significant policy questions in the field and is relevant in the respect of the international labour law regime.
