Book Criminal Law and Precrime

Download or read book Criminal Law and Precrime written by Richard Jochelson and published by Routledge. This book was released on 2017-07-06 with total page 127 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Philip K. Dick’s short story Minority Report, the institution of Precrime punishes people with imprisonment for crimes they would have committed had they not been prevented. With Dick’s allegorical inspiration, the authors of Criminal Law and Precrime: Legal Studies in Canadian Punishment and Surveillance in Anticipation of Criminal Guilt posit that recent developments in Canadian law indicate a trend toward imposing punitive measures at increasingly earlier stages of the prosecutorial process. The result is a potentially new field of criminal management that could be characterized as "precrime"—particularly the use of the law as a technology of surveillance and prevention since "terror" became a justification for intervention. The authors note that as risk management logics (based in actuarial sciences) have shifted to precautionary ones (based in administrative sciences), the law has responded by developing techniques in the arena of criminal regulation in light of the "war on terror": the need to ensure security, the proliferation of digital data, and the development of drones, social networking, and cloud storage to gather personal data. The authors view shifts in criminal investigation; the substantive criminal law of sexual expression, conduct, and work; and civil forfeiture as emblematic of precrime populism. The unifying theme of these techniques is that they occur prior to state-identified crime, arise out of a precautionary philosophy, and seek to presume (or circumvent) criminality. The book is a provocative read for scholars and students in criminal law, policing, and surveillance, as well as for those interested in how areas of law, such as immigration, health, and anti-terrorism, are mobilizing the logics of risk and surveillance in new ways that emphasize precaution. The authors invite legal scholars to place the analytical lens of precrime on criminal and regulatory practices in Canada as well as other Western nations across the globe.

Book An Introduction to Canadian Criminal Procedure and Evidence

Download or read book An Introduction to Canadian Criminal Procedure and Evidence written by Christopher Nowlin and published by . This book was released on 2017-04-19 with total page 462 pages. Available in PDF, EPUB and Kindle. Book excerpt: An Introduction to Canadian Criminal Procedure and Evidence, Sixth Edition, offers a comprehensive introduction to criminal procedure and provides a critical overview of the gathering and admissibility of evidence. The text is aligned with how the criminal justice process proceeds: from an investigative stage and initial encounter between police and suspect, to the early involvement of defence lawyers and Crown prosecutors, to the inside of the courtroom and jury selection, to the conduct of trials and the application of rules of evidence to such proceedings. It first addresses the out-of-court and pre-trial realities of the criminal justice process such as search and seizure, electronic surveillance, admissions and confessions, police powers of arrest and release, and an accused person's due process rights, including the right to full disclosure. The text then discusses the rules that govern in-court proceedings, including the rules that determine the compellability of witnesses, what can and cannot be said by witnesses, what inferences trial judges or juries may or may not draw from evidence, and how juries are created.

Book Constructing Crime

Download or read book Constructing Crime written by Janet Mosher and published by UBC Press. This book was released on 2010-05-10 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constructing Crime examines why particular behaviours are defined and enforced as crimes and particular individuals are targeted as criminals. Contributors interrogate notions of crime, processes of criminalization, and the deployment of the concept of crime in five areas the enforcement of fraud against welfare recipients and physicians, the enforcement of laws against Aboriginal harvesting practices, the perceptions of disorder in public housing projects, and the selective criminalization of gambling. These case studies and an afterword by Marie-Andre Bertrand challenge us to consider just who is rendered criminal and why.

Book The Art of Science in the Canadian Justice System

Download or read book The Art of Science in the Canadian Justice System written by Charles Ferguson and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Part autobiography, part thought piece, part references, the book takes an insightful look at the experience and cases of renowned paediatrician and forensic expert witness Dr. Charles Ferguson. The book presents the interaction of science and law as it applies, specifically, the Canadian courts, but the justice process as a whole. Dr. Ferguson's experience--from a scientist and medical professional's perspective--in dealing with lawyers, judges, and the process of testifying in numerous court--offers a unique glimpse into how the two worlds of science and law don't always mesh. In some cases the evidence is compelling and definitive. In others, far from it. Ultimately, the book presents the important role of the forensic expert and expert witness as a vital and deciding factor as the courtroom proceedings play out. The cases presented in the book--cases Dr. Ferguson was personally involved with--are interesting, the conclusions and results arrived at by Dr. Ferguson are well thought out and backed by his scientific expertise. The results and conclusions arrived at by the courts is often expected, sometimes surprising--in specific cases even controversial. Throughout all, Dr. Ferguson casts an independent, and sometimes critical, eye on the process presenting a compelling argument and heartfelt recommendation for science, objectivity, and justice to be served based on truth--truth insofar as the "facts" of the cases presented through evidence and the testimony provided within the judicial process. A fascinating read for university students, experts and witnesses, lawyers and judges, and anyone involved in the forensic process in the trying of criminal and civil cases.
