Book excerpt: Excerpt from California and the Oriental: Japanese, Chinese and Hindus The subject is one of such transcendent importance to the people of California, and is so potential with future difficulties between the United States of America and the Oriental countries, that I deem it my duty in forwarding the report to outline in brief the history of the development of the Japanese problem in California, together with the legislation already enacted and that now pending. In doing so I trust I may be able clearly to lay before you the necessity of action by our Federal government in the attainment of a permanent solution of this matter. While the report deals with the problem as an entire Asiatic one, the present acute situation is occasioned specifically by the increase in population and land ownership of the Japanese. Forty years ago the California race problem was essentially a Chinese problem. At that time our Japanese population was negligible. The Chinese immigrants, however, were arriving in such numbers that the people of the entire Pacific slope became alarmed at a threatened inundation of our white civilization by this Oriental influx. Popular feeling developed to such a pitch that many unfortunate incidents occurred of grave wrong done to individual Chinese as the result of mob and other illegal violence. Our country became awakened at the growing danger, and Congress passed the Chinese Exclusion Act providing for the exclusion of all Chinese laborers and the registration of all Chinese at that time lawfully within the country. The statute was sufficiently comprehensive effectively to exclude further Chinese immigration and to make difficult, if not impossible, the evasion of the spirit of the act. As a result of this enactment there has been a substantial reduction in the Chinese population of California. In a subsequent letter of appreciation, I re quested the writers to give me permission to print the whole or a part of their letters so that not only the members of the committee but others interested in this important problem might learn the opinions of representative Americans. I asked each writer to drop me a line if there were any objections to my so doing. In reply a few writers declined to consent to the publication of their letters on one ground or another, a large majority willingly complied, while others remained silent, from which I understood that they had acquiesced. A report in Japanese containing anonymous extracts from several of the letters was published soon after my return' to Tokyo. But the publication of the answers to the questionnaire has been delayed for reasons that I need not mention here. More recent considerations, especially after another visit to the Pacific Coast last summer, 1922, led me to change my mind. I need not mention that the very problems discussed in those answers still exist as they did two years ago, although the situation has changed remarkably within the last couple of years. This question may be affected by the location of and accommodation in the separate Mongolian school of San Francisco, We understand that there is but one Mongolian public school in the city. If it should be decided that, within the meaning of the Treaty, a right to attend a public school is a right of residence, and that the action of the San Francisco School Board is a denial of "the same privileges, liberties and rights" in respect to public school education which are granted to other residents, the question would remain, whether the act of the San Francisco authorities could be justified under the clause which excepts "laws, ordinances and regulations with regard to police and public security." It appears to the writer that the main questions relating to the proper interpretation of the Treaty are the first two as stated. Should the courts decide that the action of the School Board did violate the true intent and meaning of the Treaty, they would be confronted with the further question: Is the Treaty constitutional? If the treaty-making power of the Federal Government is limited, and if this Treaty in conferring on Japanese residents in the United States the right to attend the public schools of a State exceeds those limits, the Treaty in this respect is unconstitutional, and no more the supreme law of the land than an unconstitutional act of Congress. The question, "Can a Treaty override the Constitution?" is to-day as absurd as the question, "Can an Act of Congress override the Constitution?" The treaty-making power, as the legislative power, must be exercised within those limits, if any, imposed by the Constitution. The difficulty is to determine the extent of the treaty-making power.
