Book excerpt: EU-Canada negotiations for a Comprehensive Economic and Trade Agreement (CETA) began in May 2009 and concluded in September 2014. Signed in October 2016, the agreement's overall aim is to increase flows of goods, services and investment. This publication analyses the extent to which public services are protected in CETA. The trade agreement takes the public sector into account by means of a (general) public sector carve-out and specific reservations introduced by the EU and the Member States in the annexes to the agreement. These reservations apply specifically to health services, education services, social services, and environmental, energy and transport services. National reservations introduced by the EU Member States to complement EU-wide reservations vary greatly. To a large extent this is the result of the widely varying levels of liberalisation of certain services among Member States, leading some of them to see a greater need to protect particular sectors from foreign competition than others.

Book excerpt: This commentary focuses on Article 8.30 CETA, which is entitled 'Ethics' and sets ethical rules for the Members of the CETA Tribunal and the Appellate Tribunal. The European Commission presents this precept in a succinct paragraph, highlighting the key issues addressed and the main novelties with respect to the traditional ISDS system:CETA establishes strict rules of ethical behaviour for the Members of the Tribunal which guarantee their full independence and impartiality. Situations where a Member of the Tribunal can act as a counsel or an expert in pending or new investment disputes are prohibited. Further, CETA has a binding code of conduct for the Members of the Tribunal. The code is based on the ethical rules of the International Bar Association, subject to further revision. It prevents conflicts of interest. In case a Member of the Tribunal is found not to comply with the code, he/she will be replaced. That decision is taken by an independent outside party -the President of the International Court of Justice and not by the remaining Members of the division of the Tribunal hearing the case as is often the case in existing agreements. The commentary that begins here provides a detailed analysis of the issues emphasised by the Commission and is structured thus: a brief 'Introduction and Overview' is followed by the 'Spirit and Purpose' of the provision, after which the 'Drafting History' is systematized. Article 8.30 CETA is divided into four paragraphs and the same framework is used in the comprehensive analysis of the CETA's ethics rules for adjudicators. Finally, the brief 'Conclusion' raises some last questions that may lead to future research with relevance for the practice of investment dispute resolution.

To do so, it first examines the root causes behind the legitimacy crisis, ultimately arguing that it reflects a fundamental rule of law crisis within investment arbitration. In particular, it asserts that the normative standpoints of the legitimacy crisis form part of the rule of law, the uniting legal principle from which the legitimacy concerns stem. The book contends that the rule of law is not only the principal normative and causal assumption on which the legitimacy concerns are based, but that it could also be utilized as a platform to evaluate the investment arbitration mechanism in CETA's Investment Chapter. Based on this, the book evaluates CETA's Investment Chapter through the rule of law framework in order to provide a convincing account of the latter's ability to overcome the legitimacy crisis facing investment arbitration. It concludes that CETA's Investment Chapter is unlikely to completely solve the legitimacy crisis simply because it is just a patchwork of reforms rather than a comprehensive reinvention of the substantive and procedural law of investment arbitration. Lastly, the book offers meaningful insights into the way the challenges presented by investment arbitration should be addressed. The book is intended for academics researching international investment law and arbitration as well as for policy-makers focusing on reforming investor-state dispute settlement.
