Book excerpt: Excerpt from Business Law for Business Men and Students With mutual dependence for protection came mutual dependence for other necessaries of life. The semicivilized villagers divided the pursuits of toil. Some hunted, while others stood guard, and when, by reason of the multitude of hunters, game ceased to abound, some turned to rearing domestic animals, and some to the tillage of the soil. Then markets arose for the interchange of products, and so, out of the necessities of civilization came commerce. Out of customs controlling commerce, sprang Commer cial Law. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from American Business Law: With Legal Forms One of the most noteworthy developments during re cent years in educational courses has been the increasing prominence given to the study of business law. A few years ago this subject was taught virtually nowhere save in law schools. To-day it is being generally adopted by progressive colleges and universities. It is a study whose educational value can hardly be overestimated. It trains and exercises the student's mind, and it is of such practical utility that he cannot fail to realize its advantages. More' over, it has a rare human interest, especially if the prin ciples are illustrated with actual cases. Almost every case in the higher courts represents a conflict on the outcome of which important interests are staked. And the decision of each lawsuit not only shows the result of that particular case, but also indicates what will probably be decided in similar cases arising thereafter. Book Commercial Law for High Schools Business Colleges and Business Men Classic Reprint

Download or read book Commercial Law for High Schools Business Colleges and Business Men Classic Reprint written by Wayne Carlyle Townley and published by Forgotten Books. This book was released on 2017-12-07 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commercial Law for High Schools, Business Colleges and Business Men The laws of all the States (except Louisiana) are based upon the Common Law of England. Consequently the student knowing the laws of Illinois knows the funda mental law of all the States. It seems better to study the laws of one State than to give cases from all the States since to master one system is easier than forty-eight. There is no book on the market that deals with only Illinois law. The Author is in a new field altogether in this respect. The fundamental laws of the State can be learned without reference to Statutes or Reports. It is needless to point out the value of this to business men and law students. The aim is not to make lawyers, but to guide men in business transactions. The day of buying a book and becoming a lawyer is not here. It would be as reason able to expect one to buy a stock of drugs and become a doctor. While this is written to fit the needs of elementary study yet the Author has been gratified to learn that it has been of value as a quizzer for students preparing for the Illinois State Bar Examination. Actual cases rather than the theoretical have been emphasized. Almost without exception the illustrations are cases taken from the Illinois Supreme Court Reports, stated in the simplest language. The Specific predominates rather than the general. As far as possible technical terms have been avoided. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book A Treatise on Business Law

Book excerpt: Excerpt from A Treatise on Business Law: With Forms of Ordinary, Legal, and Business Documents; Designed for Use in All Schools in Which the Commercial Branches Are Taught and as a Book of Reference for Business Men The Reason for Commercial Law. - Nations have rules governing their conduct with each other, called International Laws. Each nation enacts laws, called Statute Laws, governing the conduct of its citizens, toward each other as citizens, and toward the State. For the same reason, men, in their private business transactions and dealings with each other, find it necessary to have law to go by. The Source of Commercial Law. - It came from England. The colonists brought it with them, and when they finally reduced the whole country to English sway the Common Law of England became the law of the United States of America. The Origin of Commercial Law. - Custom brought it about. Merchants transacted their business in an accustomed way so long that the custom gradually became the law from which no man could depart. Men exercised rights in an accustomed way, over articles of personal property or over land, for so long a time, that their rights began to be respected by others, and finally those rights, including the manner in which they had exercised them, became recognized law. Statute Law. - It is frequently found that the rules of the common law, while adapted to the condition of things in England, will not answer for the United States. The remedy is by statute laws. They are laws enacted by the Legislature of a State and they overrule the common law. The rules of law given in this book are mainly common law rules. There are some statutes, however, which have been so universally enacted by the several States, as to constitute almost uniform laws. Whenever the common law has thus been abrogated, altered or supplemented, a knowledge of the subject matter of the statute law is equally necessary. Book excerpt: Excerpt from The Law of Bankruptcy: A d104 for Business Men and Students of Business, With Copies of the National Bankruptcy Act, General Orders of the Supreme Court and the Official Forms, With Problems In the last five years there have been over 84,000 bankrupts in the United States, with liabilities approaching a billion and a half dollars. Certainly every well-informed business man ought to know something about the way in which bankrupt estates are administered and about the rights, duties and liabilities of bankrupts and creditors. Indeed, the credit men's associations have been urging business men to participate in the administration of bankrupt estates as receivers and as trustees; probably unfamiliarity with the law has been the chief cause of the business man's reticence. There can be little doubt that the business man who would undertake this work would have no more difficulty in learning the essential parts of the law than the lawyer has in learning about the important parts of a business. Unfortunately for the business man, there has been no text on bankruptcy intended chiefly for the layman. Such texts as have appeared contain too much of the technical and procedural to appeal to the average business man. To supply this deficiency is the purpose of this book. It is intended not only for business men but for advanced students in university courses in commerce. A special feature is the group of problems taken from cases adjudicated by American courts. These problems illustrate all phases of the law except those that deal with matters of procedure which are of interest only to the lawyer. Part I is the text to be studied.
