Book excerpt: Lauren Jones was attempting to rob the Aboud grocery store when the owner, Ali Aboud, pulled a gun from under the counter and fired at Mr. Jones. The bullet missed Jones and struck and killed Aboud's wife, Rachel. Jones was arrested at the scene of the robbery and has pleaded guilty to robbery. No murder charges are pending against him. The State alleges that the defendant, John Burns, planned the robbery of the grocery store and waited outside in the getaway car while Jones went inside to rob the store. The defendant has been charged with armed robbery for his alleged participation in the holdup and with felony-murder for the death of Mrs. Aboud. This basic file offers impeachment, rehabilitation issues, and adverse examination. There are three witnesses for both the State and the defendant.
Download or read book The Politics of War Powers written by Sarah Burns and published by University Press of Kansas. This book was released on 2019-11-15 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Constitution of the United States divides war powers between the executive and legislative branches to guard against ill-advised or unnecessary military action. This division of powers compels both branches to hold each other accountable and work in tandem. And yet, since the Cold War, congressional ambition has waned on this front. Even when Congress does provide initial authorization for larger operations, they do not provide strict parameters or clear end dates. As a result, one president after another has initiated and carried out poorly developed and poorly executed military policy. The Politics of War Powers offers a measured, deeply informed look at how the American constitutional system broke down, how it impacts decision-making today, and how we might find our way out of this unhealthy power division. Sarah Burns starts with a nuanced account of the theoretical and historical development of war powers in the United States. Where discussions of presidential power often lean on the concept of the Lockean Prerogative, Burns locates a more constructive source in Montesquieu. Unlike Locke, Montesquieu combines universal normative prescriptions with an emphasis on tailoring the structure to the unique needs of a society. In doing so, the separation of powers can be customized while maintaining the moderation needed to create a healthy institutional balance. He demonstrates the importance of forcing the branches into dialogue, putting them, as he says, “in a position to resist” each other. Burns’s conclusion—after tracing changes through Franklin Delano Roosevelt’s administration, the Cold War, and the War on Terror—is that presidents now command a dangerous degree of unilateral power. Burns’s work ranges across Montesquieu’s theory, the debate over the creation of the Constitution, historical precedent, and the current crisis. Through her analysis, both a fuller picture of the alterations to the constitutional system and ideas on how to address the resulting imbalance of power emerge.

Download or read book Strengthening Forensic Science in the United States written by National Research Council and published by National Academies Press. This book was released on 2009-07-29 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.

Available in PDF, EPUB and Kindle. Book excerpt: THE VIVID, SCANDAL-FILLED STORY OF A SHREWD, RAGS-TO-RICHES MILLIONAIRESS AND THE RUTHLESS POLITICIAN WHO PURSUED HER, TOLD AGAINST THE EFFERVESCENT BACKDROP OF AMERICA’S GOLDEN CITY—SAN FRANCISCO. San Francisco, until the mid-1940s, was a city that lived by its own rules, fast and loose. Formed by the gold rush and destroyed by the 1906 earthquake, it served as a pleasure palace for the legions of men who sought their fortunes in the California foothills. For the women who followed, their only choice was to support, serve, or submit. Inez Burns was different. She put everyone to shame with her dazzling, calculated, stone-cold ambition. Born in the slums of San Francisco to a cigar-rolling alcoholic, Inez transformed herself into one of California’s richest women, becoming a notorious powerbroker, grand dame, and iconoclast. A stunning beauty with perfumed charm, she rose from manicurist to murderess to millionaire, seducing one man after another, bearing children out of wedlock, and bribing politicians and cops along the way to secure her place in the San Francisco firmament. Inez ruled with incandescent flair. She owned five hundred hats and a closet full of furs, had two small toes surgically removed to fit into stylish high heels, and had two ribs excised to accentuate her hourglass figure. Her presence was defined by couture dresses from Paris, red-carpet strutting at the San Francisco Opera, and a black Pierce-Arrow that delivered her everywhere. She threw outrageous parties on her sprawling, eight-hundred-acre horse ranch, a compound with servants, cooks, horse groomers, and trainers, where politicians, judges, attorneys, Hollywood moguls, and entertainers gamboled over silver fizzes. Inez was adored by the desperate women who sought her out—and loathed by the power-hungry men who plotted to destroy her. During a time when women risked their lives with predatory practitioners lurking in back alleys, Inez and her team of women, clad in crisp, white nurse’s uniforms, worked night and day in her elegantly appointed clinic, performing fifty thousand of the safest, most hygienic abortions available during a time when even the richest wives, Hollywood stars, and mistresses had few options when they found themselves with an unwanted pregnancy. Inez’s illegal business bestowed upon her power and influence—until a determined politician by the name of Edmund G. (Pat) Brown—the father of current California Governor Jerry Brown—used Inez to catapult his nascent career to national prominence. In The Audacity of Inez Burns, Stephen G. Bloom, the author of the bestselling Postville, reveals a jagged slice of lost American history. From Inez’s riveting tale of glamour and tragedy, he has created a brilliant, compulsively readable portrait of an unforgettable woman during a moment when America’s pendulum swung from compassion to criminality by punishing those who permitted women to control their own destinies.

Download or read book Drift written by Rachel Maddow and published by Crown. This book was released on 2012-03-27 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: The #1 New York Times bestseller that charts America’s dangerous drift into a state of perpetual war. Written with bracing wit and intelligence, Rachel Maddow's Drift argues that we've drifted away from America's original ideals and become a nation weirdly at peace with perpetual war. To understand how we've arrived at such a dangerous place, Maddow takes us from the Vietnam War to today's war in Afghanistan, along the way exploring Reagan's radical presidency, the disturbing rise of executive authority, the gradual outsourcing of our war-making capabilities to private companies, the plummeting percentage of American families whose children fight our constant wars for us, and even the changing fortunes of G.I. Joe. Ultimately, she shows us just how much we stand to lose by allowing the scope of American military power to overpower our political discourse. Sensible yet provocative, dead serious yet seriously funny, Drift reinvigorates a "loud and jangly" political debate about our vast and confounding national security state.
