Starting in Miami in the 1980s and being exported enthusiastically across the world, we now have a range of international case studies to re-examine their effectiveness. Whereas traditional debates tended towards binaries like “do they work?”, this volume attempts to unpick their export and implementation, contextualising their efficacy. Instead of a simple yes or no answer, the book provides key insights into the operation of drug courts in various parts of the world. The case studies range from a relatively successful small-scale model in Australia, to the large and unwieldy business of drug courts in the US, to their failed scale-up in Brazil and the small and institutionally adrift models that have been tried in England, Scotland, Wales and Ireland. The book concludes that although drug courts can be made to work in very specific niche contexts, the singular focus on them as being close to a “silver bullet” obscures the real issues that societies must address, including (but not limited to) a more comprehensive and full-spectrum focus on diverting drug-involved individuals away from the criminal justice system.

Consistently high re-offending rates have led to the radical overhaul with almost half of all prison-leavers reoffending within 12 months - for those serving less than a year that figure rises to almost 58 per cent. For the first time all offenders, including those serving less than 12 months, will be subject to mandatory supervision and tailored rehabilitation on release from prison. Further plans include: a greater use of mentors to meet offenders at the prison gate and support them in the community; only paying in full for services that are proven to work at reducing re-offending; and opening up rehabilitation services to a much wider range of providers, who are free to innovate and do the things that work to turn offenders' lives around. What we do at the moment is send people out of prison with £46 in their pocket, and no support at all. The proposals will see all of those sentenced to prison or probation properly punished while being helped to turn away from crime for good. They will also mean taxpayers' money is only spent on what works when it comes to cutting crime. These proposals build on a consultation from last year which set out plans to open up rehabilitation services to the private and voluntary sector to drive innovation through the criminal justice system and increase the use of Payment by Results

Issues discussed include: the existing law and problems with it; the definition of murder and manslaughter; partial defences including provocation, diminished responsibility and duress; the fault element in murder and the concept of intention; and the doctrine of double-effect. The paper proposes the creation of a new Homicide Act (to replace the Homicide Act 1957) to establish clear definitions of murder and the partial defences to it, as well as defining manslaughter, within a graduated system of offences (the ladder principle) to reflect seriousness of offence and degrees of mitigation. For example, the offence of murder should be divided into two categories, of 'first degree murder' (with a mandatory life sentence) and 'second degree' (with a discretionary life sentence maximum). Responses to the consultation paper proposals should be received by 13.04.2006.

In the second part, the chapters address clinical issues such as the therapeutic alliance, clinician factors, and diversity related issues that impact treatment outcome. In the third and final part of the book, adaptions of innovative and cutting-edge evidence-based treatments such as Dialectical Behavior Therapy, Trauma Informed Care, Mindfulness, Motivational Interviewing, Assertive Community Treatment, Multisystemic Treatment, New frontiers in Intimate Partner Violence treatment, and the current research on the treatment of those with psychopathy are presented. Research supporting these treatment approaches targeting areas such as self-management, psychological well-being, treatment engagement and retention and their relationship to recidivism will be reviewed, while their adaptation for use with forensic populations is discussed. The book concludes with the editors’ summary of the findings and a discussion of the future of evidence-based interventions within the field of forensic psychology.
