Book excerpt: Excerpt from Brief Making and the Use of Law Books The first edition of "Brief Making," which was published in 1906, marked an epoch in the history of legal education and literature. Prior to that time very few law schools had attempted to give any systematic instruction in the art of brief making. The general excellence of the new book influenced a number of the leading law schools to adopt it as a text-book, and led others to establish courses of instruction founded on and following its general plan. This use of the book during the three years that have elapsed since its publication has, of course, been fruitful in suggestions for improvement. These suggestions have been supplemented by others developed from the editor's experience as a lecturer on Legal Bibliography and The Use of Law Books in the leading law schools of the country. In the present edition a large amount of new material has been added, and the general arrangement has been altered to accord with the views of teachers and practitioners whose use of the book has qualified them to judge of the needs of the student and of the profession. Those parts of the original edition which treated of the subjects "Where to Find the Law" and "How to Find the Law" have been entirely rewritten. In compliance with the desire of many instructors there has been added a new part on "The Trial Brief." It is believed that the new edition is well adapted to use as a text-book on brief making and as the foundation for a complete course of instruction in legal bibliography. The aim has been to make it suggestive and adapted to the methods of all teachers of the practical side of the law. I have called the work a treatise, although I have presented it in the form of illustrative or leading cases, with notes. But in doing this I have not misnamedx it in order to obtain for my work a more dignified title. The notes are my treatise. If any one should object that he is called upon to pay for one hundred and fifty pages of cases taken bodily from the reports which are at his hand in his own library, or which he can consult else where, I shall simply reply that he obtains them without any extra charge. In order to admit them into my book, the notes are printed in a type three sizes smaller than that in which legal treatises are ordina rily printed. Thus, while neither its size nor its cost to the profession has been increased at all, I am satisfied that its usefulness to the many members of the bar who are unable to obtain access to a complete library of reports will be greater in its present than it would have been in the more usual form of a legal text - book. And even those who can obtain in their original volumes all the cases I have here reprinted. Will hardly refuse to recognize the desirability of having within the covers of a single volume all the leading cases upon this branch of the law. I have endeavored to accomplish this and by quoting freely from the opinions of the judges, by making the statements of the facts of most of the cases cited minute as well as correct, and by embracing all the adjudications on the subject, I have aimed to make my book take the place, for the judge and practitioner, not alone of a treatise, but of the original reports of the several thousand adjudications on the law of usages and customs which it contains. In this branch of the law questions arise very frequently, and usually they must be answered on the spur of the moment. It is essential, therefore, that the lawyer have at his tongue's end the rules and their exceptions. Moreover, since the test of the keen lawyer is his ability to make fine legal discriminations, it is also essential that he possess a well disciplined mind in the art of applying them. In the present volume an attempt has been made to state pointedly and systematically these various rules and exceptions; and since the law is an applied science, numerous illustrations have been given to elucidate their application. Every topic is fully illustrated; every illustration is founded upon an actual case, and for each case the citation is given. With the view of securing compactness, these illustrations, instead of being scattered throughout the book, have been made a distinct part of it and placed after the text proper. This plan, it is believed, will meet with general approval. As an aid in developing ability to make fine legal discriminations the reader is earnestly advised to study carefully these illustrations and where practicable to do so to read the cases upon which they depend.
