Book excerpt: Excerpt from A Handbook of the Pennsylvania Workmen's Compensation Act of 1915: Containing a Digest, Full d104 of Associated Acts, Rulings of the Board and a Comprehensive Index Originally prepared for private convenience, it was suggested that this Digest and Index of the Workmen's Compensation Act of 1915 might be of some help to many of those who have more or less to do in the administration and observance of the Act. Upon submitting the matter to the Workmen's Compensation Board, they very kindly offered to recommend the use thereof, as in some measure simplifying and rendering more easy a compliance with the law. The Digest of Act No. 338 is by sections. The index, except where otherwise expressly stipulated, is to such sections, and refers, as well, to the sections of the full text of the Act, which, together with the associated acts, immediately follows the Digest. Book The Workmen s Compensation Act 1906 Classic Reprint

Download or read book The Workmen s Compensation Act 1906 Classic Reprint written by V. R. Aronson and published by . This book was released on 2015-08-06 with total page 580 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Workmen's Compensation Act, 1906 The object of this book is to present a complete view of the law of Workmen's Compensation as contained in the Act of 1906, and in the decisions of the English and Scotch courts both prior and subsequent to that Act. Eighteen months have now elapsed since the Act came into force, and during that time many cases have been decided by the Court of Appeal. These cases deal mainly with three points, each of them a fruitful subject of controversy: (i) the definition of "workman"; (ii) the definition of "earnings"; and (iii) the method of calculating "average weekly earnings" where the period of employment has been too short or irregular for a true average to be taken. As to the definition of "workman," the dispute has ranged round the meaning of the word "casual"; for it is enacted that "workman" does not include a person whose employment is of a casual nature and who is employed otherwise than for the purposes of the employers trade or business. Obviously some very fine distinctions have to be drawn. The employment of a charwoman who cleans a house daily in pursuance of a contract is clearly not of a casual nature; equally clearly the employment is of a casual nature if the charwoman has merely cleaned the house on several occasions in the past and may or may not be called on to do so in the future. Between these two positions lie very many difficult cases. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Workmen's Compensation Act: With Explanatory Notes and Decisions This Act is in many respects a great improvement on the Act of 1897, though some mistakes might have been avoided had time permitted a more thorough consideration of some of its provisions. It transcends the Bill of 1905 in that it proceeds by way of consolidation instead of reference. It is occasionally and inevitably marred through the fault of our system of government by Party, when bad laws have to be assented to in order to obtain good ones. Though many of the litigious expressions used in the old Act have been discarded there remain a number that might well have received statutory definition. It will be seen that the Legislature has traded at good deal on case-law, there being cited in this little book no less than 120 cases from the Court of Appeal alone. Book excerpt: Excerpt from Workmen's Compensation: Legal Opinions on Various Phases of the Iowa Workmen's Compensation Act Note. - The public has become greatly interested in the subject of compensation legislation as a method for improving some conditions which have prevailed under the common law system and for solving the problem of dealing justly with the unfortunate victims of our industrial life. Because of the new and unusual character of this legislation and because of the general interest in the subject, numerous requests for information are being made upon our department and upon the Department of Justice. As a convenient manner in which to supply this demand for information, a few of the more important legal opinions on the subject by Henry E. Sampson, Assistant Attorney General and special counsel to the Iowa Industrial Commissioner, have been placed in this form for general distribution. An index has been placed in the back of the work, so arranged as to give first a reference to the sections in the supplement to the code, 1913; second, a reference to the sections in chapter 147, acts 35th G. A., and third a reference to the pages of this pamphlet. - Warren Garst, Iowa Industrial Commissioner. Gentlemen: Replying to your letter of the 5th instant addressed to the attorney general will say that the last legislature of Iowa enacted what is known as the workmen's compensation act, same being found in Chapter 8-A, Title XII, Supplement to the Code, 1913. The law is optional or elective, and the employer can avail himself of its provisions or elect to reject same, as he sees fit.
