Specifically, it examines the possibility of subjecting armed groups to international human rights law obligations. First addressed is the means by which armed groups may be bound by international law. Of particular interest is the de facto control theory and the possibility that international law may be applied in the absence of direct treaty regulation. Application of this theory is dependent upon an armed group's establishment of an independent existence, as demonstrated by the displacement of state authority. This means that armed groups are treated as a vertical authority, thereby maintaining the established hierarchy of international regulation. At issue therefore is not a radical approach to the regulation of non-state actors, but rather a modification of the traditional means of application in response to the reality of the situation. The attribution of international human rights law obligations to armed groups is then addressed in light of potential ratione personae restrictions. International human rights law treaties are interpreted in light of the contemporary international context, on the basis that an international instrument has to be applied within the framework of the entire legal system prevailing at the time of interpretation. Armed groups' status as vertical authorities facilitates the vertical application of international human rights law in a manner consistent with both the object and purpose of the law and its foundation in human dignity. Finally, if international human rights law is to be applied to armed groups, its application must be effective in practice. A context-dependent division of responsibility between the territorial state and the armed group is proposed. The respect, protect, fulfil framework is adapted to facilitate the application of human rights obligations in a manner consistent with the control exerted by both the state and the armed group. One, they should assess their emotional “hot buttons” that trigger ineffective behaviors and make conflict difficult to manage. Two, they should examine their personal values and how those might conflict with what their peers find important. Finally, they should assess their power in the organization—which can be related to position, influence, expertise, or some other factor—and learn how to use it to manage conflicts. Navigating these issues won’t rid an organization of conflict among peers. But by paying attention to them managers can build effective relationships that will survive these inevitable conflicts and bolster their ability to achieve organizational goals.

Through the Comprehensive Peace Agreement (CPA) of 2005, the North–South dimension of the conflict was seemingly resolved by the independence of the South on July 9, 2011. However, as a result of issues that were not resolved by the CPA, conflicts within the two countries have reignited conflict between them because of allegations of support for each other’s rebels. In Bound by Conflict: Dilemmas of the Two Sudans, Francis M. Deng and Daniel J. Deng critique the tendency to see these conflicts as separate and to seek isolated solutions for them, when, in fact, they are closely intertwined. The policy implication is that resolving conflicts within the two Sudans is critical to the prospects of achieving peace, security, and stability between them, with the potential of moving them to some form of meaningful association.

Rachel Sarah O'Toole examines how Andeans and Africans negotiated and employed casta, and in doing so, constructed these racial categories. Royal and viceregal authorities separated "Indians" from "blacks" by defining each to specific labor demands. Casta categories did the work of race, yet, not all casta categories did the same type of work since Andeans, Africans, and their descendants were bound by their locations within colonialism and slavery. The secular colonial legal system clearly favored indigenous populations. Andeans were afforded greater protections as "threatened" native vassals. Despite this, in the 1640s during the rise of sugar production, Andeans were driven from their assigned colonial towns and communal property by a land privatization program. Andeans did not disappear, however; they worked as artisans, muleteers, and laborers for hire. By the late seventeenth and early eighteenth centuries, Andeans employed their legal status as Indians to defend their prerogatives to political representation that included the policing of Africans. As rural slaves, Africans often found themselves outside the bounds of secular law and subject to the judgments of local slaveholding authorities. Africans therefore developed a rhetoric of valuation within the market and claimed new kinships to protect themselves in disputes with their captors and in slave-trading negotiations. Africans countered slaveholders' claims on their time, overt supervision of their labor, and control of their rest moments by invoking customary practices. Bound Lives offers an entirely new perspective on racial identities in colonial Peru. It highlights the tenuous interactions of colonial authorities, indigenous communities, and enslaved populations and shows how the interplay between colonial law and daily practice shaped the nature of colonialism and slavery.

Book excerpt: Bound Together takes a new look at twentieth-century Turkey, asking what it will take for Turkish women and men to regain their lost freedoms, and what the Turkish case means for the prospects of freedom and democracy elsewhere. Contrasting the country’s field of poetry, where secularization was the joint work of pious and nonpious people, with that of the novel, this book inquires into the nature of western-nonwestern difference. Turkey’s poets were more fortunate than its novelists for two reasons. Poets were slightly better at developing the idea of the autonomy of art from politics. While piety was a marker of political identity everywhere, poets were better able than novelists to bracket political differences when assessing their peers as the country was bitterly polarized politically and as the century wore on. Second, and more important, poets of all stripes were more connected to each other than were novelists. Their greater ability to find and keep one another in coffeehouses and literary journals made it less likely for prospective cross-aisle partnerships to remain untested propositions.
