Book excerpt: Presents the report of a task force appointed to inquire into public policies affecting the financial services sector and to make appropriate recommendations. Task force work included receipt of submissions from interested parties, holding of meetings across Canada to solicit public input, and commissioning external research studies. Four basic themes are explored: enhancing competition and competitiveness, consumer empowerment, Canadians' expectations and corporate conduct, and improving the regulatory framework. After introductory chapters on these themes and the task force's approach, chapter 3 reviews forces of change acting on the sector, including technological advances and globalization, plus the responses to those changes. Chapter 4 includes an overview of the sector and its importance to Canada, and discusses challenges facing the sector. Chapter 5 presents the task force's vision for the sector and suggests how to achieve that vision. Chapters 6 through 9 treat the four basic themes in turn, covering such topics as ownership policy, business powers, mergers, protection of privacy, consumer protection, social performance, and regulation of market entry. The final chapters summarize the task force's recommendations and concluding observations.

After a detailed analysis of the relevant provisions and their effect on financial institutions in Canada, Mexico, and the United States, the author examines the impact of the NAFTA rules on the legal position of banks operating in countries outside NAFTA, particularly in the context of the WTO financial services provisions. The book concludes with a chapter on the effects of a potential NAFTA expansion. The book aims to contribute to the development of a new legal and regulatory framework distinct from those of trade and financial services law, and offers a valuable insight into how trade in financial services within a regional trade agreement develops its own legal dynamic.
