Available in PDF, EPUB and Kindle. Book excerpt: In 2002 Congress enacted the Bipartisan Campaign Reform Act (BCRA), the first major revision of federal campaign finance law in a generation. In March 2001, after a fiercely contested and highly divisive seven-year partisan legislative battle, the Senate passed S. 27, known as the McCain-Feingold legislation. The House responded by passing H.R. 2356, companion legislation known as Shays-Meehan, in February 2002. The Senate then approved the House-passed version, and President George W. Bush signed BCRA into law on March 27, 2002, stating that the bill had "flaws" but overall "improves the current system of financing for federal campaigns." The Reform Act was taken to court within hours of the President's signature. Dozens of interest groups and lawmakers who had opposed passage of the Act in Congress lodged complaints that challenged the constitutionality of virtually every aspect of the new law. Following review by a special three-judge panel, the case is expected to reach the U.S. Supreme Court in 2003. This litigation constitutes the most important campaign finance case since the Supreme Court issued its decision in Buckley v. Valeo more than twenty-five years ago. The testimony, submitted by some of the country's most knowledgeable political scientists and most experienced politicians, constitutes an invaluable body of knowledge about the complexities of campaign finance and the role of money in our political system. Unfortunately, only the lawyers, political scientists, and practitioners actually involved in the litigation have seen most of this writing—until now. Second, the Act regulates issue advocacy by creating a new term in federal election law, "electioneering communication"-- political advertisements that "refer" to a clearly identified federal candidate and are broadcast within 30 days of a primary or 60 days of a general election. Generally, the Act prohibits unions and certain corporations from spending treasury funds for such "electioneering communications." For those individuals and groups permitted to finance such communications, it requires disclosure of disbursements of over $10,000 and the identity of donors of $1,000 or more. The Act generally took effect on November 6, 2002, the day after the 2002 general elections. Certain provisions, however, had different effective dates, either to allow a transition period or, as in the case of increased contribution limits, to make the new rules coincide with the calendar year. On December 10, 2003, in McConnell v. FEC (No. 02-1674), the U.S. Supreme Court upheld the constitutionality of key provisions of BCRA. A 5-to-4 majority of the Court upheld most portions of the law, including the key provisions relating to political party soft money and electioneering communications. The Court, however, invalidated two provisions of the law: the prohibition of contributions by minors age 17 and under and the provision requiring political parties to choose between coordinated and independent expenditures during the post-nomination, pre-election campaign period.

Book excerpt: S. 27 (McCain-Feingold), the Bipartisan Campaign Reform Act of 2001, was introduced January 22, 2001 in a form similar to prior versions of the last two Congresses. On April 2, after a two-week debate and adoption of 22 amendments, the Senate passed S. 27 by a vote of 59-41. That measure’s companion Shays-Meehan bill, the Bipartisan Campaign Finance Reform Act of 2001, was initially introduced as H.R. 380 in a form similar to House-passed versions of the prior two Congresses; on June 28, the bill was modified and offered as H.R. 2356. H.R. 2360 (Ney-Wynn), the Campaign Finance Reform and Grassroots Citizen Participation Act of 2001, was introduced and ordered reported favorably by the House Administration Committee on June 28. (Shays-Meehan was ordered reported unfavorably at the same time.) The two primary features of the bills are restrictions on party soft money and issue advocacy.
