Book Social Services of General Interest in the EU

Download or read book Social Services of General Interest in the EU written by Ulla Neergaard and published by Springer Science & Business Media. This book was released on 2012-10-30 with total page 626 pages. Available in PDF, EPUB and Kindle. Book excerpt: The EU has limited legislative competence in the field of social law. However, the Member States are increasingly modernizing social services and social (welfare) protection, attempting to make social services more efficient by increasingly looking to the market for the provision of such services. This policy move brings social services into the radar of EU law. The EU response to this sensitive issue has resulted in a piecemeal and fragmented approach towards the treatment of a new policy area of Social Services of General Interest (SSGI) in EU law and policy. This book is a first contribution towards charting how SSGI have emerged as a special category of SGI in the EU, the reaction of the Member States and stake-holders and how policy is being made through new governance processes, carve-outs and safe havens in legislation and soft law, especially in the light of the new values of the EU introduced by the Treaty of Lisbon 2009. It takes an inter-disciplinary approach and will be of interest to lawyers, economists and political scientists who are interested in EU policy-making as well as practioners, EU and national policy-makers. Ulla Neergaard is Professor of EU law at the Faculty of Law, University of Copenhagen, Denmark. Erika Szyszczak is a Jean Monnet Professor of European Law ad personam, Professor of European Competition and Labour Law at the University of Leicester, Barrister, Littleton Chambers, UK. Johan W. van de Gronden is Professor of European Law at the Radboud University of Nijmegen, The Netherlands. Markus Krajewski is Professor of Public and International law at the University of Erlangen-Nuremberg.

Book Social Services between General Interest Orientation and Internal Market Dynamics

Download or read book Social Services between General Interest Orientation and Internal Market Dynamics written by Mathias Maucher and published by LIT Verlag Münster. This book was released on 2020-01-08 with total page 510 pages. Available in PDF, EPUB and Kindle. Book excerpt: The thesis analyses the EU-level policy process on "Social Services of General Interest" over more than a decade. The author identifies the factors that can explain the development and state of play of the EU-level legal, policy and quality frameworks at the end of 2016. He elaborates on relevant theories, concepts and political discourses and looks into the role and initiatives of the EU Member States and the European Commission as the key policymakers. The thesis analyses the reasons and implications for the organisation, provision and financing of social services that stem from the overarching or recalibration of national policy arenas and scopes by the internal market and the EU policy context.

Book Services of General Interest Beyond the Single Market

Download or read book Services of General Interest Beyond the Single Market written by Markus Krajewski and published by Springer. This book was released on 2015-06-23 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book ever to assess comprehensively the impact of EU international agreements on services of general interest. Services of general interest remain high on the political and legal agenda of the European Union. However, the debates about the impact of EU law on services of general interest usually focus on internal market law such as the free movement of services, competition law, state aid rules and the law of public procurement. The external and international dimensions of the European legal framework for services of general interest are often overlooked. This book addresses the impact of international trade and investment agreements on public services and the role these services play in EU external relations. It shows that the inherent tension between establishing and securing undistorted competition on markets and the logic of public services exists in international economic law in a similar way as in EU internal law. Given the contentiousness of international trade and investment agreements as well as the EU’s external policies, the issues discussed in this volume are timely and relevant and contribute to the ongoing debate about the future of services of general interest in the EU with fresh ideas and perspectives. Markus Krajewski is Professor of Public and International Law at the University of Erlangen-Nuremberg, Germany.

Book Social Services Disrupted

Download or read book Social Services Disrupted written by Flavia Martinelli and published by Edward Elgar Publishing. This book was released on 2017-11-24 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book revives the discussion on public social services and their redesign, with a focus on services relating to care and the social inclusion of vulnerable groups, providing rich information on the changes that occurred in the organisation and supply of public social services over the last thirty years in different European places and service fields. Despite the persisting variety in social service models, three shared trends emerge: public sector disengagement, ‘vertical re-scaling’ of authority and ‘horizontal re-mix’ in the supply system. The consequences of such changes are evaluated from different perspectives – governance, social and territorial cohesion, labour market, gender – and are eventually deemed ‘disruptive’ in both economic and social terms. The policy implications of the restructuring are also explored. This title will be Open Access on Elgaronline.com.

Book Services of General Interest and Territorial Cohesion

Download or read book Services of General Interest and Territorial Cohesion written by Heinz Faßmann and published by V&R Unipress. This book was released on 2015-10-28 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: European societies and economies continue to rely on Services of General Interest (SGI) to produce legitimacy. Fair access to basic services such as transport, energy and communication infrastructures, education and health care is regarded as a cornerstone of the 'European Model of Society', as a way to promote Territorial Cohesion and lastly, as a right held by every EU citizen. These collective, regional and individual perspectives on Services of General Interest are in the focus of this edited volume. In the light of postmodern societies, demographic aging, migratory patterns, globalization and economic crises territorially sensitive challenges arise and targeted solutions are needed accordingly.

Book Innovation in Social Services

Download or read book Innovation in Social Services written by Tomáš Sirovátka and published by Routledge. This book was released on 2016-05-23 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU member states have seen high levels of unemployment in recent years especially amongst young people. At the same time the fiscal crisis of welfare states has made it difficult for them to invest in new jobs and new economic growth. The EU, at least since the enactment of the Amsterdam treaty, has had a focus on how to support member states’ development of an employment policy which aims for higher levels of participation, lower levels of unemployment and more gender equal approaches. Through exploring patterns in the recent development of financing and governance of social services and developments of social services and employment in the Czech Republic, Denmark, Germany and the UK, this volume provides readers with new knowledge and evidence of the options regarding social innovation in social services. Furthermore, it provides a comparative European perspective on how the interplay between a public and private mix of social service on the one hand might help in creating jobs, and, on the other, be a way of coping with the needs and expectations of higher level of services in the core areas of the welfare state.

Book Unleashing Social Justice through EU Public Procurement

Download or read book Unleashing Social Justice through EU Public Procurement written by Antoinette Calleja and published by Routledge. This book was released on 2015-10-05 with total page 251 pages. Available in PDF, EPUB and Kindle. Book excerpt: The dramatic results of the 2014 European Parliament elections have highlighted the European Union’s urgent need for a review of the scope and purpose of its social objectives and for a reordering of European priorities. This book advocates a radical and original alternative to the current philosophy that determines the set of rules for the awarding of EU public procurement contracts. It calls for a reordering of the EU’s economic and social priorities. In doing so, it advocates for a social dimension to be placed at the core of public procurement, which could elicit a social model of integration in the EU in which the European citizen is the key actor. This is achieved through an analytical approach as well as concise and contextualised explanations relating to free trade theories, poverty and public interest theories. This book will be of key interest to students and scholars of the European Union, political theory, and EU law.

Book Developments in Services of General Interest

Download or read book Developments in Services of General Interest written by Erika Szyszczak and published by Springer Science & Business Media. This book was released on 2011-05-18 with total page 274 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the third book in the series Legal Issues of Services of General Interest. The book focuses upon a set of research questions on the recent developments in the emergence of services of general interest (SGIs) as a distinct EU concept. This includes, inter alia, the emergence of universal service obligations and the way they are regulated in the EU in primary and secondary law, the range of soft law communications adopted by the Commission to create a distinctive EU concept of SGIs, the residual role of hard law in the Treaty on the Functioning of the European Union (TFEU), the special problems created by Social Services of General Economic Interest and the interaction of procurement and state aid law with SGIs. A new perspective is offered in this book: some of the issues faced by the EU in accommodating SGIs into a regulatory framework are found also in the policy of the WTO and in least developed countries (LDCs).

Book Services Liberalization in the EU and the WTO

Download or read book Services Liberalization in the EU and the WTO written by Marcus Klamert and published by Cambridge University Press. This book was released on 2015 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Both in WTO law and EU law there is a dichotomy between liberalisation based on market access and targeting domestic regulation. Consequently, both regimes share the problem of distinguishing national measures impairing market access and those that do not have such effect. Looking at the provision of services, a cornerstone of EU substantive law, in the EU and the WTO this book offers a comprehensive evaluation of the current legal status quo on transnational services provision on a global level. Based on thorough analysis of both EU and WTO law, policymakers are provided with concrete proposals for fostering the consistency and effectiveness of the current regime. A final chapter discusses possible approaches to regulation such as home state rule, host state rule and mutual recognition from a comparative perspective. Written by a highly respected author team, this is essential reading for EU internal market specialists and WTO law scholars alike.
