Book excerpt: Que nos encontramos inmersos en un proceso de cambio tecnológico de una magnitud y cuyos efectos (presentes y futuros) no terminamos de comprender es innegable. Hasta tal punto es así, que hay quienes afirman que la Revolución Digital es un hecho disruptivo que justifica repensar (y “redenominar”) el Derecho en aras de afrontarlo adecuadamente. Por su parte, la Unión Europea lanzó en 2015 una estrategia política conocida como Estrategia para el Mercado Único Digital de la Unión Europea, con la intención de acometer la necesaria recepción jurídica de la Revolución Digital y aprovechar al máximo el potencial económico que representa. Hasta el momento las iniciativas normativas (entre Propuestas de Directiva, y de Reglamento) superan las cuarenta, y es difícil llevar la cuenta de las otras muchas iniciativas que aún no se han traducido en textos articulados.Dos de los conceptos jurídicos clave sobre los que pivota la recepción jurídica de la Revolución Digital en lo que al Derecho patrimonial privado se refiere son los de “contenidos digitales”, y “datos”. Los primeros son definidos como “datos producidos y suministrados en formato digital”; los segundos, comienzan a verse ya como una importante mercancía objeto de Intercambi, hasta el punto ser calificados como “la sangre de las venas” de la economía digital. En este trabajo analizamos el tratamiento jurídico que están recibiendo o que probablemente reciban estas nuevas realidades desde una perspectiva y una convicción muy concretas: resulta necesaria una actualización del concepto jurídico-patrimonial de bienes a nivel europeo que sea capaz de acoger estas nuevas realidades, de tal manera que puedan circular del mismo modo que cualquier otro bien, y la nueva riqueza digital no quede estancada en una suerte de resurrección (digital) del paradigma de la “propiedad en manos muertas”.

But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

While some businesses are relaying on their corporate website to make the sale, both traditional brick-and-mortar and new disruptive business models are increasingly using online marketplaces to offer their products online. European Union law has been gradually updated to reflect this new reality, with Intellectual Property Rights legislation and Consumer Law leading the way toward a suitable regulatory framework in the Platform Economy. However, the EU has not devised a comprehensive strategy for tackling the challenges posed by the online sale of physical consumer goods, such as effective public enforcement in online environments. In fact, sector-specific legislation, including Food Law, largely ignores online transactions. In this context, the book evaluates the impact that online marketplaces are having on European Union sector-specific legislation and its e-nforcement. The goal is to assess whether the existing regulatory and policy framework are sufficient for promoting compliance and bridging the enforcement gap in the digital single market. Focusing on the e-food market, the book presents a state-of-the-art overview of how online marketplaces are altering EU law and its enforcement by public authorities.

Based on fieldwork among the Purépecha of Michoacán, Mexico, some of the most talented artisans of the New World, the book is not so much a work of ethnography as of philosophy—a cultural critique of modernism.
