Available in PDF, EPUB and Kindle. Book excerpt: PREFACE This English translation of the treatise, is the second version of that work which the author has offered to the public. A French translation, from the second Latin edition, made its appearance a few months ago, and in his preface the translator claimed for it that it was more than a mere translation, that many points had, in fact, been the object of fresh study and of conscientious revisio on the part of the author, so that the volume, then issued, gave to its readers the equivalent of a third edition of the original work. The like may be said, and with even greater reason, of the present translation. Made directly from the French, its preparation has been followed throughout by the author with ceaseless care, and he has spared no pains to provide a work that should leave nothing to be desired in the way of doctrine or of erudition. In taking upon himself this task, the author was actuated, on the one hand, by a desire to meet the wishes of many brother-priesls and aspirants to the priesthood among the English-speaking clergy and, on the other hand, by the hope of rendering a service to the educated laity, by placing in their hands a work which would enable them to obtain first-hand infornation on this important subject. Not to speak of additions and corrections, the entire translation has been supervised with the greatest care. It follows the exact lines of the original work certain passages of a delicate nature being left in Latin, and faithfully reproduces every chapter. In it will be found a methodical and classic exposition of the doctrine and discipline of the Church in the matter of betrothment and marriage, from the point of view of canon law and of dogmatic and moraltheology, together with a commentary, as complete as possible, on the modifications recently introduced. addition, side by side with questions that properly belong to canon law and theology, will be found notices on history and civil law, printed in a smaller type, and giving an idea of the state and development of the eccIesiastical and civil law in this matter. The parallel exposition af the two laws and of their successive changes presents an interest which there is no need to emphasise. The work, in its English translation, is published in two volumes. An index to the complete work will appear at the end of the second volume. In conclusion, we may observe that, for the purpose of preserving the unity of the work, and in order to avoid interfering with the original arrangement of the chapters, the author has thought it better to deal with the English and American legislation on betrothnlent and marriage in the form of a supplement, rather than to insert that matter in the different chapters. The reader will have no difficulty in finding the comesponding places in the body of the work...

Book excerpt: Swedish medieval marriage formation was a process, written down in the secular laws. However, it started to evolve because of the interaction with the medieval Catholic marriage doctrine, which focused on mutual words of consent. Although first the canon law of marriage, and then Lutheran marriage dogma influenced the Swedish development, the perception of marriage as a process, consisting of several legal acts and accompanied by property transfers, proved remarkably resilient. The pragmatic and rural character of Sweden contributed to this, despite pressure from canon and Roman law and attempts at bringing marriage formation under ecclesiastical control. Marrying by stages was in itself unremarkable in Europe, but the legal foundation and formality make medieval and sixteenth-century Sweden a unique case study.

Available in PDF, EPUB and Kindle. Book excerpt: At a time in human history when women and men are more concerned about interpersonal relationships and when there is an extensive questioning of the specific relationship between a woman and a man in marriage, Marriage and Sacrament offers an understanding of how to live out the Christ-meaning and Church-meaning of that relationship so that, by living martially and sacramentally, couples can reveal to the world and to the Church the deeper meaning of all human love. The book examines the relationship among love, marriage, and sacrament; it examines the meanings of the sacrament of marriage, its biblical basis, its history and what happens when it comes to an end; it examines sexual love, indissoluble love, fruitful love, and ecumenical love in relationship to both marriage and sacrament. Marriage and Sacrament is an indispensable resource for pastoral ministers and ministry students as well as all who contemplate or are now partners in marriage.

This book was released on 2017-11-21 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Marriage Legislation in the New Code of Canon Law It comes, too, at an opportune moment. Tragic events of today, the bitter fruit of four centuries of lax thinking among non-catholic schoolmen and proportionately lax living among their disciples, have shown that the ethical order must be refashioned in the ancient Christian pattern if the race of men is to sustain itself even physically, the more so if there is to be real moral advancement. The world will not come back to Christ, nor be made subject to His reign by any influence the world itself may initiate; the impulse must be from without - the force must come from above. The Church of Christ, which is not of this world, must bring from on high the heavenly grace that will heal the nations. Her mis sion is to teach, her remedy for the world's distemper is primarily the imparting of the form of sound words. Although a chaste widowhood be more honorable, second and further marriages are valid and lawful, the prescriptions of can. 1069, 2, being observed. Can. 1143. Mulier cui semel benedictio sollemnis data sit, nequit in subsequentibus nuptiis eam iterum accipere. A.woman who has once received the solemn blessing can not receive it again in subsequent marriages. 337. 1. The teaching of the Church in regard to second marriages has always been the same as that of St. Paul, who exhorts widows to remain unmarried, without imposing it as an obligation, rather advising marriage when the single life might be too dangerous. (Rom. vii, 2, 3; 1 Cor. vii, 39, 40; 1 Tim. v, 14; cf. Hernias, lib. ii, Mand. iv, n. 4; Tertullian, Ad uxorem, ii, 1.) The Montanists and Novatians, who absolutely forbade second marriages, were condemned. (Nice, c. 8.) Those marriages, however, were looked upon with a disfavor, which was expressed by some ecclesiastical writers in such strong terms that at times they seem to amount to a formal condemnation. (Perrone, De Matrimonio Christiano, vol. iii, p. 73; Chardon, Histoire des Sacrements, Du Mariage, c. iv, art. 1; Martene, De antiquis Ecclesise ritibus, lib. i, c. ix, art 1.) In the Greek Church, from the beginning of the fourth century, second marriages were subjected to various penances. (Neocsesarea, 314, c. 3, 7; Ancyra, 358, c. 19; Laodicea, 380 ? c. 1; St. Basil, ad Amphilochium.) Third and fourth marriages were treated still more severely until they were condemned as unlawful or even as invalid except under certain...
