Book excerpt: In the past three decades, a stream of criminological inquiry has emerged which explores, measures, and theorizes crimes and harms to the environment at the micro-, mezzo-, and macro-levels. This “green criminology”, as it has come to be known, has widened the criminological gaze to consider crimes and harms committed against air, land (from forests to wetlands), nonhuman animals, and water in local, regional, national, and international areas or arenas. Accordingly, green criminology has endeavored to understand the causes and consequences of air and water pollution, biodiversity loss, climate change, corporate environmental crime (e.g., illegal waste disposal), food production and distribution, resource extraction and exploitation, and wildlife trade and trafficking, while also exploring potential responses to these issues. This book seeks to introduce the green criminological perspective to a broader social science audience. Recognizing that green criminology is not the first social science to explore the phenomena and harms at the intersections of humanity and ecology, this book offers an introduction to some of the unique insights developed over nearly 30 years of green criminological thought and scholarship to students, professors, researchers, and practitioners working in the fields of anthropology, economics, environmental humanities, environmental sociology, geography, history, and political ecology. This book contains contributions from researchers in green criminology from around the world, including early- and mid-career scholars, as well as more established voices in the field—all of whom are dedicated to exposing, understanding, and ultimately hoping to thwart further environmental degradation and despoliation.

It allows multinational companies to shift profits to low tax jurisdictions and thus reduce their global effective tax rates. A major international project, launched in 2013, aimed to fix the system, but failed to seriously analyse the fundamental aims and rationales for the taxation of multinationals' profit, and in particular where profit should be taxed. As this project nears its completion, it is becomingincreasingly clear that the fundamental structural weaknesses in the system will remain. This book, produced by a group of economists and lawyers, adopts a different approach and starts from first principles in order to generate an international tax system fit for the 21st century. This approach examines fundamental issues of principle and practice in the taxation of business profit and the allocation of taxing rights over such profit amongst countries, paying attention to the interests and circumstances of advanced and developing countries. Once this conceptual framework is developed, the book evaluates the existing system and potential reform options against it. A number of reform options are considered, ranging from those requiring marginal change to radically different systems. Some options have been discussed widely. Others, particularly Residual Profit Split systems and a Destination Based Cash-Flow Tax, are more innovative and have been developed at some length and in depth for the first time in this book. Their common feature is that they assign taxing rights partly/fully to the location of relatively immobile factors: shareholders or consumers.

With detailed attention to the debates around formulary apportionment and its theoretical foundations, the book provides a blueprint for rebuilding the normative framework for the EU’s tax reform by clearly analysing the implications of the following and more: theorising public benefits to be represented by taxation; reorganising different economic theories about tax neutrality and tax justice; advancing the comparative legal research methodology to analyse law reform by combining the functional approach and the problem-solving approach; designing the logical formulary apportionment system for digital economy; ensuring the removal of the incentive for multinationals to shift reported income to low-tax locations; reducing the tax system’s complexity and the administrative burden it imposes on firms; eliminating transfer pricing complexity for intra-firm transactions; achieving equal weighting of the sales factor, the labour factor, and the asset factor in the formula; application of ‘destination-based’ rule for attributing the sales factor; and replacing the traditional permanent establishment nexus with a ‘factor presence nexus’. The presentation incorporates extensive comparison between the EU’s formulary apportionment tax reform option and FA systems existing in the United States (US) at state level, including reference to relevant US case law and legislation. As a possible option to address the problem of base erosion and profit shifting (BEPS), formulary apportionment is gaining increasing acceptance and attention. This book will prove invaluable to taxation authorities, tax practitioners, and scholars in its deeply informed and systematic guidance on good practices and prevention of problematic experiences in establishing and implementing an effective and market-neutral FA system.

In this perspective, the efficiency of the main models is examined and two fundamental proposals are put forth: the first one aims at a coordination of the Destination-Based approach with the role of some specific digital assets, such as user data; the second one is a framework for a possible futuristic tax phenomenon all internal to the world of the internet and not linked to traditional territorial States. The compliance of these models with the constitutional principles that western democratic systems have affirmed over time in matters of taxation is then analyzed with particular regard to legal certainty, consent to taxation and to the re-distributive function of taxes. A specific evaluation of the role of the European Union is carried out and the jurisprudence on financial interests of the Union and on State aids is analyzed and tackled in light of the Treaty on the Functioning of the European Union and of the tax sovereignty of member States. The conclusion is that the model of the organization with a general political purpose, from which modern States take their inspiration, appears unfailing for a tax project that would focus on the good and the growth of the person and of the social aggregations in which everyone lives. A model that therefore deserves to be safeguarded, although with new methods and instruments, starting from a Destination-Based Asset-Coordinated approach, in the Third Millennium. The book will be of interest to researchers and academics in international tax law, constitutional law and in political science.

Book excerpt: This book provides the first comprehensive study of Jewish travel and mobility in Hellenistic and Roman times, based on a critical analysis of Jewish, Graeco-Roman, and early Christian literary, epigraphic, and archaeological sources and a social-historical evaluation of the material. Catherine Hezser shows that certain segments of ancient Jewish society were quite mobile. Mobility seems to have increased in the later Roman period, when an extensive road system facilitated travel within the province of Syria-Palestine and the neighbouring Middle Eastern regions. Second Temple Judaism was centralized, with Jerusalem as its central space and seat of priestly authority. In post-70 rabbinic Judaism, on the other hand, connections between rabbis could be established through mutual visits and second- and third-degree contacts only. Mobility formed the basis of the establishment of a decentralized rabbinic network in Palestine and Babylonia in late antiquity. Numerous narrative and halakhic traditions indicate the importance of mobility for communication and the exchange of knowledge amongst rabbis. It is argued that the rabbis who were most mobile sat at the nodal points of the rabbinic network and elicited the largest amount of influence. They would have combined business travel with scholarly exchange. Scholars' journeys between Palestine and Babylonia are viewed within the wider context of Rome and Persia's economic and cultural exchange in which Jews, just like Christians, may have played the role of intermediaries.
