Book excerpt: It is the adjudicating county's responsibility for the detention of juveniles. A sheriff's office may operate a juvenile detention facility for the county. If a county will not be detaining juveniles in 1993, then they would not be required to meet the requirements set out in K.S.A. 1991 Supp. 38-1691(e). However, if the county plans or expects to detain a juvenile in 1993 and does not have in place a permanent plan for housing juveniles, then the county must meet the requirements of K.S.A. 1991 Supp. 38-1691(b)(4) and (e). While a county is not statutorily required to establish an attendant care program in addition to the county run detention center, this may be desirable so as to prevent overcrowding. A county which operates a detention facility that is not recognized by SRS would not be eligible for construction funding through SRS, but may still apply for federal funding pursuant to 42 U.S.C. section 5633. Counties utilizing the provisions of K.S.A. 1991 Supp. 38-1691 are required to establish a community committee to implement their plan pursuant to K.S.A. 1991 Supp. 38-1691(e)(1)(D). Book excerpt: Pursuant to K.S.A. 8-237 the chief law enforcement officer of a local unit of government can only recommend to the division of vehicles if an applicant should be issued a driver's license. The final decision rests with the division of vehicles. Cities and counties are not able to use their home rule powers to deny licenses to persons under the age of 16 years if the statute is uniformly applicable and does not grant such authority. Allowing the raising of the driving age to 16 years, in some counties but not others, will not violate an individual's constitutional right to equal protection. Cited herein: K.S.A. 8-237, Kan.
