Book excerpt: Pursuant to K.S.A. 19-2918c, a county planning board has no authority to review subdivision plats before they are filed with the register of deeds unless the planning board has enacted subdivision regulations pursuant to K.S.A. 19-2918. Under these statutes, a board of county commissioners has the authority to approve subdivision regulations, but has no authority to approve or review a final plat which has been approved by the county planning board. Regardless of the existence of subdivision regulations, however, K.S.A. 19-2633 requires that subdivision plats of land located more than one mile from the limits of an incorporated city be approved by the board of county commissioners before such plats may be filed with the register of deeds. The provisions of this statute are applicable in Cowley County, which has a county planning board (appointed pursuant to K.S.A. 1983 Supp. 19-2915) that has not adopted subdivision regulations. The filing and recording of a plat vests title to property designated for public use in the county, and such property is to be held in trust for the purposes of the dedication. A decision as to when a road or public way dedicated to public use is opened or put in condition for public use is within the discretion of the governing body charged with the responsibility of maintenance. Subdivided land which has been platted pursuant to K.S.A. 19-2633 is subject to the restrictions stated in the plats. Thus, while certain acts described as sex offenses in the criminal statutes may not be punishable crimes if committed with a child age 16 years or older; those same acts may constitute abuse of that child under the definition of that term in the Code for Care of Children. However, the quorum requirements of K.S.A. 13-1810 are provisions of an enactment of the legislature which is not uniformly applicable and may be changed by charter ordinance. Such charter ordinance will be subject to the "protest" style election authorized by Article 12, Section 5(c)(3) of the Kansas Constitution. "Majority," as the term is used in K.S.A. 13-1810, means the number one greater than half the number of members of the governing body and may not be changed by ordinary city ordinance. Only if the request cannot be met within this time must the custodian of the records provide an explanation of the cause for further delay. In addition, the phrases "provide access to" and "permit inspection of" are used interchangeably throughout the bill, and may accordingly be treated as synonymous for purposes of interpretation. Book excerpt: Pursuant to K.S.A. 8-1008, as amended by 1983 Substitute for House Bill No. 2132, community-based alcohol and drug safety action programs are authorized to perform a variety of services relating to persons who have been arrested for the offense of driving while under the influence of alcohol. Included in such services are evaluations of persons being considered for diversion or who have been convicted but not yet sentenced. Certification of the programs which are authorized to so act in each judicial district is determined by the administrative judge of the district or, in the event such judge declines to do so, by the Secretary of the Department of Social and Rehabilitation Services. Such certification is for the limited purpose of providing the services specified by K.S.A. 8-1008, as amended, and does not act as a substitute for licensure under K.S.A. 65-4001 e̲t̲ s̲e̲q̲. and 65-4601 e̲t̲ s̲e̲q̲. In that diagnostic services are included within the definition of treatment contained in the latter acts, a community-based alcohol and drug safety action program must be licensed under such acts before it may offer such services under K.S.A. 8-1008, as amended. Book excerpt: Property seized from a pawnbroker and held by law enforcement officials for use as evidence in a criminal proceeding is regarded as being in c̲u̲s̲t̲o̲d̲i̲a̲ l̲e̲g̲i̲s̲ and subject to the court's order as to the disposition thereof in the same proceeding. If the property is identified as being stolen, it is the duty of the court and the state to see that the property is restored to its rightful owner at the earliest opportunity. However, the due process rights of the pawnbroker must be respected, W̲o̲l̲f̲e̲n̲b̲a̲r̲g̲e̲r̲ ̲v̲.̲ ̲W̲i̲l̲l̲i̲a̲m̲s̲, 774 F.2d 358 (10th Cir. 1985), and the Court should provide the pawnbroker with notice and opportunity to be heard before releasing property to the apparent owner. In Kansas, this agency is the State Board of Education. Thus, if one or more cooperative agreements are made, the federal moneys provided the state under 29 U.S.C.A. section 1533 must be made available to the State Board of Education. Those moneys may not be made available directly to service delivery areas. The State Board, of course, must use the moneys received for the purposes, and subject to the requirements, prescribed in section 1533. Should such advertisements be accepted for publication, a newspaper would not be engaging in any activity which is included in the criminal offense of promoting prostitution (K.S.A. 21-3513), which, as a penal statute, must be narrowly construed.
