Available in PDF, EPUB and Kindle. Book excerpt: GAO reviewed the private and State warranty programs that were developed to protect home buyers from construction defects in new houses. The review was made to assess the growth of these warranty programs and the protection that they provided through federally assisted housing programs. Until recently, new-home buyer's protection from construction defects was limited to that described in the purchase contract. This has generally been replaced with warranties that define the builder's responsibility to correct construction defects. However, enforcing these warranties is difficult when builders refuse to or cannot make repairs. To help alleviate this problem, the insured warranty concept was developed. These new warranties: (1) protect the home buyer during the builder warranty period if the builder cannot or will not stand behind the warranty; (2) provide 10-year insurance against certain major stuctural defects; and (3) include an inexpensive and independent process to settle claims. Federal agencies have taken initial steps to use insured warranties in their housing programs. Several benefits are derived from using insured warranties on federally assisted houses, including: (1) furthering the desire to encourage improved home warranty protection; (2) providing home buyers with improved warranty protection; (3) reducing Federal expenses for correcting structural defects; and (4) reducing Federal construction inspections.

Book Homeowner Warranties and Building Codes

Download or read book Homeowner Warranties and Building Codes written by Carl R. Gwin and published by . This book was released on 1997 with total page 47 pages. Available in PDF, EPUB and Kindle. Book excerpt: Buying a new home involves particularly unique risk because no one knows for sure if everything works. Two sources available to new home buyers to guard against risk are Building Code Enforcement by local government and Homeowner Warranties. Our purpose in this paper is to assess their effectiveness in assuring builders exert the level of effort necessary for optimal workmanship. We contend the answer to this question lies in how effective a Homeowner Warranty or Building Code Enforcement is in overcoming a moral hazard problem associated with unobservable builder effort. Builders have an incentive to claim and charge for high unobservable effort level in constructing homes, but actually exert low effort to earn higher profits. We find that a Homeowner Warranty increases the unobservable effort of the builder, but cost minimizing behavior by the builder results in an effort choice less than the most efficient level. On the other hand, Building Code Enforcement essentially converts unobservable builder effort to observable effort and efficient effort is indeed possible if enforcement cost is justifiable. We then assume the existence of a local Building Code and delineate the optimal provisions of a Homeowner Warranty. The model is generalized to allow for an evaluation of which items in a new home should be covered by a Building Code, a Homeowner Warranty or both. The results of our model are consistent with our findings from a preliminary survey of local builders and hold even if builders are compensated for good reputation.

Book Insurance in Residential Construction

Download or read book Insurance in Residential Construction written by Canada Mortgage and Housing Corporation. Research Division and published by . This book was released on 2004 with total page 58 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Canada, home builders acquire protection via various forms of insurance, including, among others, builders risk insurance, wrap-up general liability insurance and contractors comprehensive general liability insurance. Together, these types of coverage, whether purchased on a project-by-project or continuous basis, not only provide builders with protection for loss and liability throughout and following construction projects but also act as a means of securing the interests of financial stakeholders associated with the project(s). This study was designed to satisfy the following key objectives: Ÿ Develop an understanding of the issues surrounding builders risk insurance; and Ÿ Develop an understanding of the issues surrounding post-construction liability insurance. Primary research for this study consisted of conducting nationwide interviews of residential construction companies, insurance underwriters and brokers, and associations and lending organizations, while secondary research consisted of documentation and literature reviews of previously published articles, research and proprietary association and company materials. According to the research conducted, the insurance market for all types of commercial coverage has hardened over the last three years. A "hard" market designates an environment characterized by rising prices and reductions in capacity to underwrite insurance. The market has reacted to the events of September 11, reductions in reinsurance capacity, poor underwriting results and a difficult investment climate. The insurance industry's appetite for insuring residential construction projects has been particularly weak in response to widely publicized catastrophic fires at construction sites at several different locations across Canada and the emergence of new risks such as mold and terrorism. The insurance market for residential construction is contracting, with lower risk tolerance and fewer companies participating in the market. Over the last three years, home builders have identified construction insurance as a critical problem area with reports of higher premiums and deductibles, reduced levels of coverage, new warranties and conditions attached to the policies, as well as refusals of coverage. These recent developments are a cause of concern in the housing industry with respect to the cost and availability of insurance. The cost of insurance ultimately affects housing affordability and the profitability of the home builders' business.
