Download or read book Resisting Protectionism written by Helen V. Milner and published by Princeton University Press. This book was released on 1988 with total page 343 pages. Available in PDF, EPUB and Kindle. Book excerpt: Milner explores the similarities between the economic conditions of the 1920s and the 1970s, where both Western Europe and the U.S. had high unemploymnet rates and sizeable agricultural and industrial overcapacity. She draws on evidence from six U.S. industries in the 1920s, six U.S. firms in the 1970s, and six French industries in the 1970s, and concludes that in the 1970s both nations had corporations with international market interests than they had in the 1920s. She believes that in modern industrial nations, the corporate sector plays an important role in policy determination, and that any move toward protectionism would be at the behest of large corporations with international interests. Download or read book Private International Law and Global Governance written by Horatia Muir Watt and published by OUP Oxford. This book was released on 2014-12-18 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: Contemporary debates about the changing nature of law engage theories of legal pluralism, political economy, social systems, international relations (or regime theory), global constitutionalism, and public international law. Such debates reveal a variety of emerging responses to distributional issues which arise beyond the Western welfare state and new conceptions of private transnational authority. However, private international law tends to stand aloof, claiming process-based neutrality or the apolitical nature of private law technique and refusing to recognize frontiers beyond than those of the nation-state. As a result, the discipline is paradoxically ill-equipped to deal with the most significant cross-border legal difficulties - from immigration to private financial regulation - which might have been expected to fall within its remit. Contributing little to the governance of transnational non-state power, it is largely complicit in its unhampered expansion. This is all the more a paradox given that the new thinking from other fields which seek to fill the void - theories of legal pluralism, peer networks, transnational substantive rules, privatized dispute resolution, and regime collision - have long been part of the daily fare of the conflict of laws. The crucial issue now is whether private international law can, or indeed should, survive as a discipline. This volume lays the foundations for a critical approach to private international law in the global era. While the governance of global issues such as health, climate, and finance clearly implicates the law, and particularly international law, its private law dimension is generally invisible. This book develops the idea that the liberal divide between public and private international law has enabled the unregulated expansion of transnational private power in these various fields. It explores the potential of private international law to reassert a significant governance function in respect of new forms of authority beyond the state. To do so, it must shed a number of assumptions entrenched in the culture of the nation-state, but this will permit the discipline to expand its potential to confront major issues in global governance.

Download or read book State Practice Regarding State Immunities La Pratique des Etats concernant les Immunit s des Etats written by Council of Europe/Conseil de l'Europe and published by BRILL. This book was released on 2006-06-01 with total page 1067 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of the Council of Europe Pilot Project on State Practice Regarding State Immunities carried out under the auspices of the Committee of Legal Advisers on Public International Law (CAHDI) since 2002. It presents and analyses the material submitted by 27 Member States and one Observer State of the Council of Europe, including decisions of national courts, relevant legislation and other documents. The analytical report was undertaken by the Department of European, International and Comparative Law of the University of Vienna, the British Institute of International and Comparative Law and the Graduate Institute of International Studies, Geneva. It compares State practice with the relevant articles of the UN Convention, the European Convention on State Immunity and the draft articles prepared by academic institutions. It is the first in depth-analysis of European State practice in the field of State immunity. Such a broad analysis is essential, in particular for the ascertainment of customary international law. This book is addressed to officials, practitioners engaged in business relations with foreign States, and academics.

Download or read book Capital Investment in Steel written by William Thomas Hogan and published by Free Press. This book was released on 1992 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: The author discusses the uses and sources for capital in the steel industry in the 1990s. Arguing that the massive capital investment of the 1980s will continue, he identifies areas where this capital will be spent, including pension schemes, anti-pollution measures, and joint ventures between steel companies, both domestically and internationally. Additionally, as privatization continues in the 90s, more capital will shift from government-owned facilities to private individuals. Hogan asserts that capital which was readily available in the 1980s, will be more difficult to obtain in the recessionary 1990s, but available for projects deemed necessary to prepare the industry for the 21st century.
